EA "its Complicated"

Hi All,

Just had a call from the EA that i contacted yesterday to arrange a viewing on a house i like.

I've done some research and the house has been on the market for 2 years and has steadily been coming down in price.

The EA just rang and started the conversation with "i need to explain something to you, and its a little complicated"

I waited with baited breath thinking the worst!

apparently the owners received an offer a year ago on the house which they accepted, but due to various "Issues" it had not progresses even though the person putting the offer in was insistent they where still progressing! and the seller has packed up most of the house waiting to go (poor things)

She said "i've spoken to the vendor and advised them that as far as the EA are concerned the house is still for sale and if they get a reasonable offer they should take it and forget about the other chap"

She said, i just wanted you to be aware

now my question is, if i'm interested and put in an offer, what are the chances that i'm going to get into the middle of a nasty situation and end of getting into a bidding war............as i'm so not the tyoe of person that wants to do anything like that.

Also am i been strung a line?

Whats our thoughts?

    If they're willing to do it to someone else then they would be willing to do it to you. Are you willing to risk solicitor's fees, mortgage surveyors fees, searches etc for the same thing to happen to you?
    I'm an ARB-registered RIBA-chartered architect. However, no advice given over the internet can be truly relied upon since the person giving the advice hasn't actually got enough information to give it with confidence. Go and pay someone!

    Thanks for you responce Marcg, don't know if i was clear, its not the seller with "issues" its the buyer who hasn't been progressing the sales as they have "issues"

    The Seller is boxed up and ready to know, but the buyer is stalling

    Not a FTB, but just sold ours STC (we also have some money in the bank that we could use for a deposit if needs be, once ISA clears :) )

    We are going to see the house on Saturday.........can't wait:D

  • The estate agent & vendor could have made up this story of an existing buyer - to stop you from thinking "this house has been on the market for 2 years, no one wants it, I'll put in a low offer...".

    If that's the case then it worked.

    I think what markg was saying is that if the seller decides to sell to you he would effectively be doing the dirty on the current buyer (the one who is stalling) so in that case he may well do the dirty on you if another better offer comes along.
    You'll just have to weigh up the risk. It sounds like you can move quickly so if you like the house why not go for it. If the seller has waited over a year for the other buyer and is still waiting surely the seller would love to sell to someone else. But I'd take anything the EA says with a pinch of salt. Can you speak to the seller directly and ask him why the other buyer is stalling. You can also get a feel for whether you're being messed around or not.

    I would have no reservations about putting an offer in.

    Anyone who has not progressed in a year is a timewaster and I am surprised the Vendor has been so patient unless the offer was very generous and worth waiting for?

    Rejecting an offer after a year of waiting would not make me worry that they would do the same to me if I could progress normally with the sale.

    Sounds plausable to me.

    It doesnt happen everyday but it is a situation i came across a few times - generally more when i was working further North.

    Sounds like the seller has decided to commit to the buyer (believe it or not, some people do actually like to stick to their promises of selling/buying from someone) and doesnt want to admit that the buyer probably doesnt want to go ahead.

    Go ahead and view it again - if you want it then put in an offer. The situation for the seller will change a whole lot more once an official offer is on the table. A more typical scenario is this : I advise the seller to reduce the price as there is no chance that they will receive the figure they are asking for. Their response? "Im not taking a penny below £x". When the offers come in from a potential buyer, believe me, their attitude changes sharpish

    We had an offer accepted on a property in the letter back from the estate agents it states " although the property is not activley being marketed, if anyone shows an interest we are legally obliged to tell the vendors" Or words to that effect. I dont think you are stepping on anyones toes, a year is a long time to wait.

    Go and see get a feel for the house and the seller if she shows you around, and if you want to offer then offer what you think is the right price, You can take out insurance, to cover your fees if she then " does a dirty on you ! "
