Black Horse HP agreement - Help Needed Please?

My mum has taken out a HP agreement for a car in Feb 2009, the finance is with Black Horse HP. I drive the car and the car is registered in my name with the DVLA.
This vehicle was an ex demonstration car and the net price was £7500. This car has had major issues from month 2 and the car has been back to the dealership 5 times in the last year!! They eventually agreed that the clutch and the steering rack needs replacing. (Not good considering the car is not even 2 years old and it has done half it's estimated mileage.
Good news is that the dealership is going to replace the CAR!!! :j
HOWEVER!!!! BAD NEWS = Black horse will not take a zero invoice and switch the finance onto the new car!!!
This means that my mum will have to take out a NEW finance agreeement (which does concern me as her finances are not great at the moment) and mine are not great as I was declared bankrupt in 2005 (however this was discharged in the same year) and I am extremely concerned that we will lose the amount of £1900 we have already paid, as if this is a new agreement, it will probably be over 5 years!!! This situation is causing us such stress!!!
Is there anyway they can switch the finance over to the new vehicle as it is a like for like model??? Afterall it is not our fault the car is faulty is it??

i would say that you have had the car for almost a year(52 weeks)the £1900 works out at £40 per week,a hire car would have cost £20 per DAY!!!0

I think in this case its tough tomatoes, as neither your or Black Horse actually own the car. And its neither the dealership, nor the finance companies fault the car has broken down.
This is ofc a pessimistic view, but seems the most realistic.0 -

Do you not think that I can complain to Black Horse finance and ask them to change this under exceptional circumstances?? and Black Horse do own the car BTW.

It was not helpful atall Mr Rude!! :mad: in fact I have spoken to both the garage and the finance company this morning and they are going to cancel the agreement for me an unwind the finance, therefore giving me a full refund!!! so you clearly know nothing about HP at all do you?? Lol!!

Ask the Finance company to let your mum sign a modifying agreement.
Their security is stronger as the new car will have more value.
All a modifier agreement does is to replace the old subject of hire, ie your old car, with the new car details and they can then de-register your old car details with HPI and enter your new car details.0 -

Many thanks for those of you who left helpful comments, but it seems that this situation has been completely resolved!! Yippee !!
After speaking with Black Horse, for over 2 hours yesterday to a complaints manager for BH, customer services, as well as the dealership, BH have agreed to accept a zero invoice, due to exceptional circumstances. Which means that they will replace the new car details onto their system and the financial credit agreement remains the same.
I did mention paragraph 2 of the financial agreement very clearly to the which states.
"If you receive unsatisfactory goods or services paid for under this agreement you may have a right to sue the supplier, us or both"
Which means that the replacement car will be here early next week, hurrah!!!
See it does pay to complain in a very assertive way!!0
