I bought a memory foam mattress in June 2009 which has subsequently collapsed. After sending photographic evidence the reponse I received was:
"We thank you for providing pictures of your mattress. We can see evidence of settlement which is normal and to be expected, and will even out as long as the mattress is regularly rotated. However on this occasion we will ask the manufacturer to replace the mattress for you. "
There is no way that they would be willing to replace the mattress if this settlement was normal. What makes me really angry is the fact that they refuse to admit to a problem. Unless they can admit to a problem with an explanation of how it had been rectified, I dont understand how a replacement of the exact same thing will behave any different in 12 months time.
I dont want the same mattress. I actually want my money back but that aparently is not an option. How can I insist on them replacing it with a different mattress at least.
They insist that that option will only be available to me if the same problem occures again. I did love the bed for the first 12 months - even though my husband has always hated it.
Should I just be grateful for the replacement and give up on the arguement?0 -

Ah, Sensaform. They are Sleepmasters own brand, so they weren't asking the manufactuers to replace it, they were sorting the replacement themselves.
If you do a search for Sensaform in the MSE forum, you will find many complaints about them. So it could be that they were aware of a problem with that model mattress.
I'm sure some legal eagle will correct me if I'm wrong, but the way I understand it, if they had admitted that the mattress was faulty, then you could have insisted on a refund.
If I were you I would contact trading standards, and see what they suggest. It may be that even though they haven't admitted that their was a fault, they have strongly implied that there was by their actions.0 -

You would be entitled to a replacement mattress, or if that model was no longer currently available the replacement must be of equal or better quality.
If the fault had appeared in a short space of time after purchase you may then be entitled to a refund. But unfortunately as you have had the product a while, the company are in their rights to either repair or replace within a reasonable about of time.
Also note the contract of sale is with the company that sold the product and not the manufacture.Helping the country to sleep better....ZZZzzzzzzz0 -

Actually Pinkypants is right. I missed the bit about when you bought it. However there is the fact that they only sell their own brands that could go in your favour. You could say that you have lost confidence in all their own products due to your own experience, as well as reading about other peoples experiences.
Like I said, ask trading standards what they think. You do still stand a chance of a partial refund.
The company that sold the product is the same company who makes it.0
