Returning faulty clothing...

I bought a dress for my daughter from Zavvi. When I zipped the dress up the zip split and wouldn't budge as we we're away from home and going to a party I had no option but to sew her into the dress and then cut around the broken zip to get her out of it as the material wasn't stretchy. I contacted Zavvi to ask for a full refund as the dress is faulty to which they replied NO as A) the dress has been worn and B)I damaged the dress more by cutting around the zip OH and I should have phoned them to ask what I should do. OBVIOUSLY I should have returned the dress with my daughter still in it!

Anyway having spoken to a MANAGER today she has told me that I have to return the dress to them and then they will send it back to the manufacturer and if the manufacturer says the zip is faulty they will give me a refund...

Could anyone please give me advise on my rights.

    If they prove that the zip was faulty then you may get something but tbh I doubt it.
    You damaged the dress deliberately - I doubt they need to take it back at all.

    Going to the party wasn't a life or death issue.You chose for her to wear the dress,you shouldn't have if you were expecting a refund.
    The Manager has offered to send it back now-what more could you ask for?
  • As far as I am aware, if you find fault with a product you are supposed to stop using it. Zavvi could argue that your daughter continued to wear the dress knowing that it was faulty.
