I have been a member of a gym for 6 months and my wife was made redundant since, so we could no longer afford to go.
It is a one year deal I signed but should they not take into account a change in circumstance?
During asking/argueing for a "payment/membership holiday" we were banned but they still want the 3 months money whilst I was complaining to head office - Director etc.
Basically they gave me a 3 month amnesty but still want the 3 months money for when I didn't pay but was also barred from going.
What are my rights here, if any?
Can I get out of the contract at all?
I don't actually see what I have to gain by agreeing to be a member for one year. Could I not just pay the difference if it was dearer month to month? How does it all work legally?0 -

That was my point exactly, at the point that my friend advised he was cancelling membership they stopped him from using the facilities. both parties breached the contract. In any case he paid up so after taking the "ignore it and it will go away" approach to the fight.

Am I correct in thinking that the gym only refused access to their facilities once the direct debit paying for them had been cancelled? If so, then I think that puts a slightly different spin on the situation as there would be no reason for the gym to continue to allow access to someone who had already made it clear that they did not intend to pay for the service, and I don't think that would necessarily count as "agreement" to terminate the contract as you suggest.0

I was employed by a well known gym as a Membership Advisor and I was horrified to be told that even though the membership contracts weren't actually legally binding however, I would still be required to demand payments from members. I left the employ!0
