  • No I'm annoyed because although they did sell the property, they didn't actually perform all of their own stated service obligations, nor did they follow the guidelines according to the own regulator. Instead of looking at my complaint seriously, they dismissed it. If they had actually, for a moment, just apologised, this might have all been resolved already. We should expect more from estate agents then to just sell our properties at any cost, whilst providing a bad service.

    Then I think you should blame yourself.

    You should have told the buyer to deal through the agent. It strikes me that you seem to have acted like a limp rag rather than being firm with both agent and buyer - perhaps in the belief that this was the way to get the sale through. You should have insisted on a few things in writing, and only if you didn't get them should you now be taking this forward. You seem not to have asked for specifics at the time nor have any record.

    From what I have read, the EA has done their bit; they found you a buyer and the property has been sold.

    Ok, so it was a first time buyer, who probably didn't know what they were doing. If you'd not intervened, then I'm thinking the property still would have sold, albeit taking a little longer, and you would have had a much lower solicitor's bill and phone bill.

    Did you specifically say to the EA that you wanted to complete by a certain date?

    Did you request no first time buyers?

    Did you request you only wanted viewings from people in a position to proceed?

    You need to be a LOT more specific, and will actually need to list in your complaint times and dates of calls you made, their content, and what was achieved by your intervention. You will also need to show timings proving that the EA was slow and unresponsive.

    Often first time buyers stall no end, and there can be long delays.
    Should've = Should HAVE (not 'of')
    Would've = Would HAVE (not 'of')

    No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)

  • I would imagine you will have to prove the Agent did not fulfill the terms of his contract

    If you can't do this I would suggest that you give it up, pay his commission and save yourself a lot if time, money and hassle.
