Warranty Cover for Electrical Equipment

Hoping someone can point me in the right direction? I was given an HP laptop for Christmas 2008. There was a problem with the screen and I returned it for repair just before Christmas 2009. They have now told me that as the screen fault is internal it's probably caused by accidental damage and is therefore not covered under warranty. They have quoted £150 for the repair. The laptop has never left my living room and is in pristine condition - I definitely haven't damaged it in any way. What are my rights?

    You will have to get a independent report to prove that the goods have an inherent fault and thus dont comply under the sale of goods act

  • This is unusual as with laptops, if the outer of the screen breaks then that is your fault due to accidental damage (ie if the screen cracks etc...) but internal components should be covered, was the screen cracked at all? As internal components breaking can't usually be accidental damage.

    I'm afraid that neverindebt is correct here. It would be up to you to prove that this is not a fault of your doing. If you can do so then you can seek a repair, but HP do not have to do anything at any point if their warranty only lasts 12 months. Your rights under Sale of Goods Act are with the retailer. They may ask you to provide a proof of purchase, so ensure you also have that.

    Unfortunately most of you have missed the fact that the OP was "given" the laptop, he didn't purchase it himself therefore isn't the consumer.

    Not missed, but as she is unlikely to have PoP anyway, it could be a moot point. That's why the answer I gave was general in it's nature. Had she said that her mother/father/partner bought it and had the receipt then I would have advised that they would have to return it to the retailer as the claimant under SoGA.

    As this is a first time post (and unlikely OP will come back) I wasn't going to get into too much detail. But yes, you are right Neil. OP isn't the consumer.

    I don't have a PoP as the laptop was a gift from an ex and I don't know where it was puchased from.
    I have now received the HP report which states that the glass is broken internally - they say this is usually caused due to closing the display with an object on the keyboard (something I have never done). The report is actually called a misuse written statement.

    In that case there's not a lot you can do other than getting your own report done, you certainly have no rights against the original retailer. Try looking around on ebay to see if you can buy a replacement screen for your laptop model, you may be able to pick one up for less than the quoted repair bill but then you'd have to fit it as well. Maybe it's worth just stumping up the cash for the repair.

    What's the model no. of the laptop?
