PS3 replacement SOGA

Hi,

My PS3 got the YLOD (yellow light of death) beginning of December. After asking on here I was pointed in the direction of the SOGA. I printed the info off and visited Game who agreed to repeir it free of charge as I had only owned it for 2 years 2 months.

I got the PS3 back 6 days ago and it was working fine but today it has again got the YLOD! I've contacted Game to ask for a replacement as the same fault has occurred but they said their policy is to return it for repair twice. I asked them what happens then, do I just visit my local store and they give me a new one but they said "no" they would give me a giftcard with £190 as this is the amount it cost to buy a refurb. I then asked if I could just go to the store and buy a refurb exactly the same and they said no as they no longer sell the model I have!

It costs £250 to buy a brand new PS3 so I would have to pay out £60. I was under the impression that they should supply me with a like for like item :confused:. When I questioned the man I spoke to in the call centre he said I would have to take them to a small claims court if I wasn't happy about the amount and that most people accepted that amount so they could upgrade to which I replied that I shouldn't have to be paying out an extra £60 I haven't got to spare for a PS3 that's only worked for 2 years :mad:

So where do I stand on this as the item is unavailable? Do they have to give me a new one? WHEN the PS3 breaks down again I need to know my rights. Also, mine is covered by their warranty until October but to buy a refurb would only have 3 months cover.

    You are wrong.

    You are entitled to a refund/repair or replacement.

    A refund can be partial to reflect the use. Charging you £60 for 2 years + use seems very reasonable.

    The only issue would be a giftcard. You should be entitled to a refund in cash/card.

    Be aware though they are perfectly allowed to only partially refund and if you demand cash Im guessing you would get a lot less than £190.

    Im afraid the above poster is right, Soga does allow partial refunds, and they can insist on repairing again. If you read through your notes on SOGA you should be able to see this.

    £60 for 2 years use is extremely fair.
    Back by no demand whatsoever.

    Under soga your only entitled to £150 ie Cost of purchase / number of expected to last 5 times by (number of year it should last - number of years it has)

    250/5-50

    50* 3 = 150

    Also worth noting that game could have told you to go get an independent engineers report to prove the fault is inherent which they didn't sounds like quite good customer services there.
  • I just got this from the SOGA. As I've had 2 years use of it I accept £60 is fair. Not what I wanted to hear though ;). Hopefully it will be written off so I can get a new one.

    • If repair and replacement are not possible or too costly, then the consumer can seek a partial refund, if they have had some benefit from the good, or a full refund if the fault/s have meant they have enjoyed no benefit
