Incapacity Benefit and also being on DLA Middle Rate Care

Hi All

I'm aware that for people living alone and also no one is claiming carers allowance and they are in receipt of Income Support and DLA Middle Rate Care, they are entitled to Severe Disability Premium which is very significant as this amounts to an extra £51 approx per week.

I would like to know that if someone is on Incapacity Benefit and they are then awarded DLA Middle Rate Care are there any additional premiums they might be entitled to?

I was also wondering on what grounds can someone apply for an Income Support "top up" of income when on Incapacity Benefit?

The person concerned is 54-year old male and has been on Incapacity Benefit for a number of years now and has just been awarded DLA Middle Rate Care. His Incapacity Benefit is paid at a rate of £89.80 a week I believe.

    You may qualify for the Disability Premium if you and your partner are under 60 and one of you receives:
    • Disability Living Allowance
    • Incapacity Benefit (long-term rate) or, in certain circumstances, at the short-term higher rate
    • Severe Disablement Allowance
    • Working Tax Credit disability allowance
    • a vehicle under the Invalid Vehicle Scheme or War Pensioner's Vehicle Scheme, or have a grant towards an invalid vehicle
    • are registered as blind or are treated as blind
    • Statutory Sick Pay or are incapable of work or treated as being incapable of work for the qualifying period or because they are protected by the 52 week linking rules (see below).
    Enhanced Disability Premium
    You qualify for an Enhanced Disability Premium if you and your partner are under 60 and one of you receives Disability Living Allowance higher rate care component. You also qualify for an enhanced disability premium if you claim main-phase Employment and Support Allowance and receive the support component (even if you are not claiming Disability Living Allowance higher rate care component).

    Severe Disability Premium
    Severe Disability Premium is awarded at the lower rate to single claimants or couples where: Attendance Allowance or Constant Attendance Allowance or the middle or higher rate DLA care component are received, and no one is entitled to [URL="javascript:gotoHelpPage('carersallowanceinfo')"]Carer's Allowance (CA)[/URL] for looking after them.

    There are no premiums on IB but being awarded DLA might entitle him to IS because IB is over the rate of IS but with DLA your applicabled amount that the goverments says you need to live on gos up enabeling people to qualify for IS if they fit into the other criteria to claim IS as being disabled.

    The Disability Premium for a single person is £27.50 so added to the basic income support amount of £64.30 he should be receiving £91.80 providing the other conditions are met.

    On top of this he would receive the SDP if the conditions are met.
