land registery / deeds question

We sold our house, and bought a new one at the end of october 2009.

How can I confirm that my solicitor has done all the necessary work (ie with deeds and land registery for our purchace house?)

Do we get any written confirmation or a copy of any documents.

The reason I ask is that our solicitor was an idiot, totally incompetent, (but thats another story, i'll not bother you with!)

Anyway, Im still subscribed to mouseprice etc, and the stats are clearly there for the sale of our old house, but nothing about the sale/purchace of the house we bought, but as we obviously bought and sold on the same day, and are in the same area etc, shouldnt both sales be showing?

I know these sites are not always up to date, but as one is there, I would expect the other to be as they were done on the same day.

I have tried to contact my solicitor to confirm if he has done it, but have got knowhere, he has got his money from me and he is not bothered.

Any advice about how I can find out?

    You can check on http://www.landregistry.gov.uk/wps/portal/Property_Search - small fee but it will tell you the registered owner of the property.

    Thanks Rsykes, thats worth it for £4 !

    Having problems with the 'third party server' on the site, but will try again later.

    Am I right to think it would be reasonable that the solicitors should have done this by now?

    If its not been done, then my gut feeling is thats its likely to be the solicitors fault (my gut feeling as they were rubbish at the time of the purchase) or could I be totally misjudging them, and there is a processing delay/backlog/ at the land registery?

    Your solicitor gets 28 (or 30 can't remember) days to register the sale/transfer/purchase of a property at HMLR. As most things are electronic there now it could easily have been done online. I'd pay the £4 to check for peace of mind.
    Otherwise a phone call to your solicitor and the Law Society will sort that out ;)

    Thanks Hells, we sold nearly 3 months ago, so well outside the limit, 28 or 30!

    Tried calling the solicitor, hopeless, didnt get anywhere!..2 quick examples:

    My solicitor did searches on the WRONG property, we told them and they agreed to correct the error, but when we went in to sign the contract ready for the exchange, all the paperwork and advice still related to the wrong property!!..

    also the seller refused to complete a fixtures and fittings form for us, and our solicitor didnt seem to think it was a problem, I had to call him every day and pester him, until ultimatley I said I was not prepaired to sign the contract without it, he then chased up the vendors solicitor.

    ..so you can see why the absence of my purchace on mouse price has me thinking this way!

    Enough ranting, I'll put my mind at rest, £4 is a small price to pay for that!

    Don't rely on Mouseprice for Land Registry data; they could be months behind
    Go to the organ grinder, and not the monkey, if you see what I mean :)
    If your solicitor has failed to register the sale then report him to the Law Society for [EMAIL="!!!!"]!!!![/EMAIL] practice.

    No we didnt, its a local firm, which we were 'bullied' into using by our estate agent....im older and wiser now:o it was a big learning curve
    for me that its all about backhanders and commision, the quality of service to the customer is their last priority!
  • The people at the Land Registry are very helpful indeed; at least Birkenhead Office is; nothing is too much trouble.
    Phone and ask them.
  • Sometimes if there are delays in registering then they are down to delays in the seller's mortgage lender providing the evidence that their mortgage has been paid off., which is in turn down to poor lender internal organisation.

    If a solicitor tries to register a transfer into his buyer client's name the Land Registry will leave the old mortgage on there still affecting the property and the buyer's new mortgage lender will not like that.

    As a retired conveyancing solicitor I believe the information given in the post to be useful assuming any properties concerned are in England/Wales but I accept no liability for it.

    Just called the land reigstery, VERY helpful.

    They said they would advise me on a 'yes/no' basis, I gave them my name, they said ' no, that is not the name of the current registered owner'

    I said the name of the people who we bought the house from, and they 'yes, that is what is showing on our records, they are still the legal owners'.

    He said I needed to chase it up with the solicitor, as the house still legally belongs to the previous owners, and could be used to pay off any debts that the previous owner may have!!:eek:

    Should I also contact my mortgage provider, as my mortgage is not based on a house, if ive not bought it!
