Can someone advise please?

Hi,

Thanks for reading this, I have a situation at the moment, we are renting private accommodation with 2 adult's and 2 kiddies. The boiler packed in on sat and we have not had hot water or heating. We have been in touch with Shelter and they have advised us to take out a crisis loan to move properties as our landlord has told us he is not sure when the boiler can be fixed, the only problem is we have used our limit to move into the current property and are still paying off the debt.

Does anyone know anywhere we can get help from?

  • I would have thought the answer would be to find a way to force the LL to make the repair,perhaps cab could advise on this?
    I sympathise as our boiler packed in in december and we are waiting for a warm front grant to replace it during the coldest winter for years

    I could hold the rent but then i will be kicked out, CAB have advised us to get in touch saying that he has 48 hours to repair from the time that it was reported. but he says the boiler is old and he does not know where to get the parts from. We are in such a pickle because we dont want to upset the ll but we need it done. The only option we got is to move but we cannot afford it

    If I was you, I would be telling LL to sort out someone who can fix the boiler. If he is worried about getting parts etc then does that mean that he wants to do the repairs himself??

    Ring your LL and tell him you will arrange a plumber or whoever.... gasman etc, to call out and you will send the bill to him.

    I don't think it's acceptable that he is leaving you without heating/hot water in this weather!!

    You could try and ring for a crises loan as they are different to the budeting loans and I don't think these are taken into consideration when applying.

    We have been in touch with him he seems to be doing nothing tbh. We have told him we will get someone in and he has stated in the tenancy agreement we are not to have any plumber or any electrician out, therefore we are stuck. Thankyou for the reply. Will be on the phone asap in the morning to JCP

  • Your local council has powers to enforce rules - and boilers need to be serviced every year by a Corgi approved fitter, who will provide a certificate of safety. Now, it is possible that this has been done...

    I would contact the council and ask to be put through to the department that delas with private renting. Once through, I would expalin the situation and ask if the landlord has an obligation to repair or replace the boiler. I would imagine the answer will be yes. If I am correct, the council can then give you the correct advice on what to do next, including whether you can contact a repairman yoursself and bill the landlord. They might even give the LL a ring to remind him of his responsibilities - it could give the LL the nudge he needs. If not, they can pursue the LL through legal channels and the courts. Most LLs would want to avoid this.

    Local authorities now have more powers than they used to have. I have seen reports in my local papers about LLs that have been taken to court and received heavy fines when they have not fulfilled their legal obligations. I would think that a working boiler is a legal obligation, especially if there is nop other form of heat available.
  • Though you do need to bear in mind that if you are out of your tenancy agreement and on a rolling contract that your LL can ask you to leave without giving a reason, I am not saying you should leave it but just making you aware.
  • But bear in mind also that the Landlord may not be able to get someone to do the repair within 48 hours. Plumbers/Gas fitters are very busy at this time of the year!

    Thanks for the reply. We are at the moment going around relatives homes in the day but its costing us silly fuel prices.

    I fully agree with you that they are busy at the moment and i feel sorry for anyone in the same predicament.
