pre BR bank/CC charges

hi, prior to BR we incurred loads of charges on credit cards and loans. Now some of them still had balances on them when we went BR, could we still claim on them???

Also OH had a loan for motorbike, paid it in full but had loads of charges on, it wasnt in BR, could he claim??

Just a bit of a long shot really i suppose......

any help greatly appreciated

  • Any monies claimed pre Bankruptcy is not yours to have but would form part of the estate that the OR would have to pass onto creditors. Furthermore, they would have every right to offset it against any amounts written off. I'm sorry, but pre Bankruptcy, is a non starter.

    thanks for the reply, but the loan that was not included in the BR and was paid off over3 years before had charges on, could this still be tried or is this a non starter too?

    Anything not included in the BR is fine but any bank accounts/loans/credit cards etc,etc, is out of the equation.

    thanks for that, will have to get OH to request a copy from lloyds, the charges ran into about 1000 or so over 3 years. He paid on the first of the month but the payment was actually due on the 28th, so he incurred charges every month. This was the start of a very slippery slope, hence why we ended up BR. Oh well will try and see if its possible........
