lcd tv warranty - manufacturers or retailers responsibility?

i purchased a 32" lcd tv with a 3 year warranty from ebuyer in dec '07
boxing day '09 the tv fails to power up, after trying different sockets & cables the tv remains in standby and will not switch on.
i contacted ebuyer and they state the warranty is with the manufacturer, Teco. After a short phonecall i'm informed that a courier will bring me a reconditioned tv and take away the faulty unit. fair enough, i can't argue with that.
however, after 2 weeks i have contacted teco again just enquiring as to the status of the recon tv. they say that they do not have any in stock, they do not know when they will have any and cannot give me any sort of timescale as when to expect to recieve a tv.
should i continue to wait... it could take months.. or do i have any rights to pursue this warranty claim from ebuyer as i purchased the tv from them and not teco?
any helpful advice is very much appreciated

The manufacturer are responsible for the warranty and so far they seem to be doing the right thing, in fact I'm pleasently surprised to see that they've given you a loaner in the meantime, not all would - was this the same as the one it replaced? As you've already gone down this route there's very little you can expect from ebuyer at this stage.0

Legally it's the retailer who is responsible for the goods under the SOGA.
However if the manufacturer offers a warranty on the items and if you take it up, then the retailer can't intervene.
Have you sent the TV back to the manufacturer or not?I'm not cynical I'm realistic

Actually I've just had another read of your post and may have misunderstood.
Have they picked up your Faulty TV yet?
Are they saying that at the moment you can't have a replacement loan set?0 -

at the moment they are saying that they do not have a replacement tv (same model) for me "in stock", so i'm stuck with the faulty unit until they get some in. it will be a straight swap, i get a reconditioned tv (same make & model) and they take the faulty unit away.
i don't have an issue with that, but i'm at the mercy of their non existent stock, i don't want to be waiting months.0 -
If they cannot rectify the fault within a reasonable timescale, they should offer replacement. after getting nowhere with Teco, ive decided to have the tv checked out by a local tv repair company & then return it to ebuyer for a partial refund under the SOGA
i'll keep the thread updated0 -
