Competition Winner Rights?

Hi,

I recently won a competition in a major magazine which was entered by text message costing £1. The prize was worth around £165.00 by the magazines reckoning on their competition page. Sadly the prize has never actually materialised, I've chased this with the magazine who have dismissed my enquiry with a "it must have been lost in the post".

My question is this, does anybody know where I stand legally with the magazine in terms of claiming some kind of compensation?

    What proof have they sent you of you being the winner of the competition, what were the competitions terms and conditions? what correspondence have you had since in writing (ie have they said anywhere that they confirm you were the winner, that you're prize is being mailed by 'X' service or you should recieve it by 'X' date.

    You will need to give a bit more info to be able to help.

    The Institute of Sales Promotions [EMAIL="complaints&#64;isp.org.uk"]complaints@isp.org.uk[/EMAIL] lay down the guidelines which comp organisors must follow. MSE Compers have reported that they are very good at investigating dodgy comps & missing prizes with one chap in particular [EMAIL="edwinm&#64;isp.org.uk"]Edwin Mutton[/EMAIL], being an absolute star.


    If you can't get the Magazine to deal with your problem I would suggest you e.mail the above with as much detail as you can.

    My proof of being the competition winner is the text message sent back to me after the closing date asking me to email my contact details to them.

    The terms and conditions are fairly brief and fairly standard. The only reference to postal services is them claiming they won't accept proof of delivery as proof of receipt for entries etc. There's no mention of how or when the prize will be sent out.

    The only correspondance I have are emails between myself and the magazine chasing the prize. They have not indicated when it was sent or by whom, only that I should have received it by now.
