Car accident settled 22 months on - advice please

Hi All,My husband was hit by a driver in march 08. The driver denied liabilty, ignored his insurer for months on end so finally in oct09 our insurer asked would we take it to court. We did and 3 days before the hearing last week the other driver admitted liability. My husbands policy ended in march 08 and he started a new one in sept 08 when he got a new car. On that policy he declared 3 yrs no claims as he lost 2 and didnt earn the year he had the accident. In september 09 he renewed his insurance and declared 1 yrs no claims due to an at fault accident by me. My question is can we claim any difference in the policy from sept 08 and sept 09 as he should have had 6 yrs no claims and can we have our policy amended with our current insurer?Thanks for any replies!Louise

  • If the other party is at fault, thenI cannot see why not, though when Freda's Go-Tart was hit, we got hit the first year until the insurers got the money of the other driver.

    As for an at fault accident, ours NCB was reduced when I dented the front on the M5 18 month ago. If you get no joy, shop around.
  • Best thing is speak to the insurer for sept 08 and say that the claim was settled in your favour be prepared to provide them written evidence. Then they may put your NCD back to the level you was on. If this takes you over 4 years ask them if you could protect it? Some might some wont. Then depending on what they say you can do depends on how many years NCD you have after you fault accident.

    If they wont allow you to protect the NCD after they hopefully increased it back to 4 years or more then at the very least the NCD you come away with is the same as you started.

    If they allow you to protect the NCD then your bonus wont go down because of the claim...

    You can only ask and like I said earlier they may or may not allow the protection...

    Thanks for the replies. I am gonna wait for written confirmation then ring the insurers. As far as I can see if the idiot had admitted liability in the first place my husband would have had 6 years no claims so he should now have 4 as he had 2 yrs took off him when I had my accident.   • Thats how I would see it... When you get this thru also ask them if you could protect the NCD at September 08 (you would of been in your rights too) then the fault claim you had your NCD wouldnt of been reduced... It all depends on how the underwriters see it... At the very least your NCD would be 4 years!

    There is no chance of an Insurer back dating protected no claims bonus

    I have heard of 1 or 2 that has allowed it... but that was a couple of years back the last time I cam across it...

    It does not happen, to prevent abuse you can only add it when you take the policy out or at renewal time.

    The only exceptions I have ever known (and they are very rare) are where in the OPs situation it is well documented that they advised the Insurer at the renewal that when their ncd was reintated they want pncb and the Insurers agreed to it. The only other time is where the client had pncb and had lost the pncb due to the amount of claims and it was stepped back. In these cases they will normally reinstate back to pncb when the claim is settled in your favour

    Just an update............hubby called the insurer he was with at the time of the accident and they have amended their records showing not at fault and his no claims have been returned. He has also called his insurer from sept 08 and is due a refund of £113. He is ringing his existing insurer tomorow! He is shattered from all the talking lol.
