Stuck in a property owners partnership...

Hi

need some help in my situation with my rented house.

I divorced in 2005 but in agreement with my ex is that he would pay mortgage instead of paying child maintenance payments for our children.

I since moved out in 2008 to move in with a new boyfriend and at that time the ex and I agreed to rent the house out until property market stablized and then sell.
I was ok with this situation.

We both own the house 50-50.

A year ago I requested to sell the house...the ex agreed.....he said he would buy me out if I took less than 50-50. We negotiated a price and I agreed on just under my share for quickness of sale.

A year on and we are still nowhere. He has one excuse after the other for why he has not yet bought me out. I then suggested just to put it on the market...but he just keeps coming back saying he'll buy me out instead.

Its clear I need a solictior to now force it through and for him to realise Im serious, fed up and want out...I want to buy a new home and not have my equity stuck in a rented out one.

The only problem I have now is that I cant afford solictiors fee's for this...I think I'll need at least 300 quid for just an hours apt and a letter sent to the ex...

Has anyone had any experience of being able to pay the solictior after the sale/transfer of equity?? or if it'll have to be upfront?

Or can anyone offer me any helpful advice on my situation?

PS: I have the deeds and doc etc not the ex!!
