Can i reclaim 'strange' fees from 'Black horse'/TSB please?

Hello all,
Please can someone give me a bit of advice? My friend has had a list of all the payments that he made when he had a car loan from Black Horse and we/he are unsure of if he can claim back any charges.

On his Statement of charges it says 'Collect activity fee' of £530 that was applied after he had paid the debt off!
Also there was a late payment int' of £20.96 on the statement? The statement shows aa direct debit payment of his monthly payment and then a 'DDR LACK OF FUNDS C' where it looks like they refunded his bank account the exact amount! This happened on 4 consecutive occasions with no visible penalty, which I thought odd/lucky?

Now, to me, this looks like my friend made an 'overpayment' of £4150 to make the balance minus £394.00, Black horse added a 'Collect activity fee' of £530 to make the balance £136.00 my friend owed, then they added a 'Late payment int' fee of £20.96 to make a balance of £156.96 and then 'gave' my friend a rebate of, coincidentally, the very amount he owed of £156.96!!
A bit odd dont you think??? sad.gif

    To know really whats gone on you need to look at the credit agreement and terms of the loan.

    Was he in arrears when he settled the account ? or was there just those 4 second issue direct debits ? How long was the agreement over and how long left to go when he paid it off ? How much was the loan for, and what was the% rate ? Also did you have PPI ? Really need the figures off the credit agreement first.

    Its not odd or lucky. This is where his bank bounced the payments due to lack of funds. It is these where he has incurred the fees and extra interest. He probably incurred bank charges as well as the same time.

    for four transactions ? that's over £100 a time.

    from other black horse issues it seems they charge £25 late payment fee if they have to attempt a DD collection a second time. That doesnt scan really.

    hence needing to know a bit more detail.

  • I had a BH loan for a car and never missed a payment.Was getting near to the loan ending and I had a phone call from BH wanting to know if I wanted another loan and why I was over £350 in arrears.Now I queried this with the telephone operator and got her to email me through a breakdown of my account.There was COLLECT ACTIVITY FEE of £335 and LATE PAYMENT INT of £45.73.Now I got her to look through the account never a missed payment and never a late payment.I then enquired why the charges were on my account and she could not answer but could talk to a supervisor about it.No more than 2 minutes later the supposed supervisor agreed to wipe off the charges but I was never given an explaination of the said charges from the supervisor.The actual telephone operator tho told me it would be for late payments (but as there was no late payments at all on my account it must of been a mistake).Strange how these fee/charges were the last items on my statement of account.

    Hi, ok i am going ahead with claiming back the 'Collect activity fees' from Black Horse, plus the 'Late Payment Interest' too!
    Please can anyone tell me is using the template for credit card charges and editing like this ok:

    Agreement number: ********
    I am writing to request that you repay all the late payment fees and/or over limit fees/Collect Activity Fees/Late Payment Interest that have been applied to my account.

    I do not believe the charges reflect the true cost to Black Horse and are unfair and disproportionate. I am therefore requesting a refund based on the Unfair Terms in Consumer Contracts Regulations 1999.

    This is supported by the Office of Fair Trading’s April 2006 statement into credit card or loan charges, which noted that the level of charges at the time, and prior to that period, were unfair.

    The charges total £5**.**, plus as I believe I have been unlawfully deprived of the money I have calculated £**.** interest at the statutory rate, the amount the court will award.

    I therefore ask that you repay me the full amount of £***.** I have attached a full schedule of the charges and interest with this document.



    I look forward to a full response to this letter within 14 days.
