Bit of Advice needed please...Santander (was first national)

Hi ,
i sent a letter to first national for my Husband :confused:before xmas regarding default charges and ppi, i sent the 1st template letter off here asking for statements. I received 3 letters back from 3 different people
the first letter i received says.
The info available appears that the ppi was added on 13 nov 2003, unfortunately due to the time elapsed i have been unable to retrieve a copy of your agreement.

She then says further on,
The insurance was added to your account because you chose to do so, However you still had the opportunity to change your mind.

then,,
In relation to the reference to the sales process, there was no requirement to record the sales process so therefore we have no way of knowing what took place on the 13th November 2003. I have found no evidence of mis-selling of this insurance.

She also writes that as it is from 2003 the FOS has no jurisdiction over the complaint. is this true? i thought you could claim back to 2001?

I am completey baffled:confused: by this letter as she seems to contridict.. that there is no records/evidence on my issues but she is sure i do not have a claim??

Also on the 2nd letter it states that there were no default charges and only 1 ppi payment charged on 13 april 05, but yet i haven't received any staements or copies of statements from them. i have one statement from my records that clearly showing 5 taken in the months may, june, july, august and september of 2004.
Are they supposed to provide copies by law?
Where do i go now with this or is it a waste of time?:confused:

    Seems like they have contradicted themselves here.

    Not all were covered by these regulators until Jan 2005, so many of us been caught up in this situation, but there are other ways around this, find out who the insurer actually was and go through these, some of us have here.

    If the FOS are unable to look at these complaints because they were not protected by the FSA, then the insurer would have been.

    However, what I would do in your case is write back to the bank you received these from and take photocopies of all the letters you have received, do not send them back the originals, and tell them you believe they must hold some details due to the response you have received, (see enclosed copies of letters received).

    Ask them to reconsider, and also for the details of the Insurer.

    The FOS are able to consider investigating against the insurer in your situation.

  • Yes you advice has helped me loads, as the letters completely puzzled me. When i calimed for myself from mbna credit card it was so straight forward and got my cheque within 10 days of receiving there letter. I Will write the letter today and post it recorded tomorrow, and await the response,,
