    No i do owe this money i had an Egg CC which i said before. I would borrow the £200ish and go from there is what i meant/said, from a friend.

    Penguin83, yes your right, how long would it take for the suspension to go through, am worried that the times may overlap and someone will come knocking. I am in receipt of WFTC and CTC so i shouldnt have to pay the fee? Would the courts contact CL Finance immediately?

    Am afraid I know nothing about debt/court etc. but I do know one thing - Baliffs CANNOT come into your house unless you have left an opening ie. Opening the door, leaving a window open.

    My sister was going through CCJ process to obtain money owed to her by an ex and I know therefore that there is a wealth of information on the process and different stages on the HMCS website. The court staff should also be able to assist you (in terms of giving you information).

    As soon as the court receives your application they will get the warrant back off the bailiff and nothing will happen until the outcome of your application.

    The court will send the claimant a copy of your application along with a form for them to complete. They have 3 options, they can
    (a) accept your offer of payment in which case the court will draw up on order telling you when and where to pay,
    (b) request a higher monthly instalment, in which case the court will do a determination based on the info you give on the N245 and make an order or
    (c) reject your offer completely, then it is listed for a 10 minute hearing for a judge to make a decision

    They have 16 days to return the form or the court will automatically make the order at the rate you have offered.

    Sorry the reply is so long but you sound worried so wanted to put your mind at rest. Phone the court if you want to make the application and let them know you are filling it in. They will pass a message onto the bailiff who more than likely will hold off for a week or so until your form gets to court. The court bailiffs are so stretched at the minute, that they wont make a call if its not needed.

    Well, your immediate problem is getting the debt dealt with. But don't forget the child. Once you have your head around what you need to do, I think you would do well to tell him or her - without flogging yourself in the process - this could be an important life lesson. How old are they?

    With regards to paying the fee if you are in receipt of working tax credit and child tax credit you may have to pay the court fee. Add up your wages, your partners wages (if applicable), your child tax credit, your working tax credit and your child benefit to give you a yearly figure. If this figure is below the cut off point (which varies depending on if you are single/part of a couple and how many dependant children you have) then you will qualify for full remission.

    Unfortunately the court will ask for a lot of proof :-
    3 months or 5 weeks wage slips for you
    3 months or 5 weeks wage slips for your partner
    child benefit letter
    child/working tax credit award notice for 09/10 year
    3 months bank statements for you and partner.

    You have up to 6 months to request a refund though, so if it is easier pay the fee, keep your receipt and then request a refund when you have all your income proof together xxxx

    He is a very mature 13 year old. I will tell him, i think you are right although i dont want to worry him into thinking that he isnt safe in his own home.

    Thanks for the advice i will call the court on Monday, do you have to go there to fill it in? I think i need to book an afternoon off work, to get this sorted.

    If you have a printer you can print one off and fill it in now, if not the court will have a form there you can complete or take away with you to send back or you can ask them to post one out - counters are generally open 10-4 and phones 9-5

    Just check if you have had snow though that they are open on Monday the website will give you a list of closures that keep getting updated x x

    I never thought of the snow, we are due a dumping here tomorrow!

    If i can borrow the £200ish can i still go for a suspension, i am just so worried that someone will come when i arent in and my boy is....

    Am i right in thinking its a court baliff that visits? if thats the case they should communicate quite quickly, i think its sinking in.

    Only you know how your child will take things but hopefully he will learn to seek help if he gets into debt problems and hopefully learn to avoid bad debt. Hopefully he will also learn that nothing is unsolvable and that everyone makes mistakes but you have got to face up to them and deal with them so you can move on.
    It very much depends on the court how quick off the mark they are to be honest - some will be snowed under with work and others less so - it really does depend.
    I would try and phone National Debtline or CCCS - one to get the ball rolling to get some help and also hopefully National Debtline can reassure you and point you in the right direction.
    Oh and there are things bailiffs can and can't do so have a look on National Debtline and read up on your rights.

    You are getting good advice on the debt front, so nothing to much add.

    With your lad, obviously he can see that something is up, so it could be something like "mum has a problem. we are a bit short of money and I borrowed some, which I haven't been able to pay back fast enough for the lender. But I have gone to the MSE website, and I am getting good advice and we are going to deal with this". And when you have, don't forget to tell him.

    Obviously you don't want to burden him, but sometimes the unknown can be more troubling than the basic facts.
