Please Help Me

am sat here crying, i am in debt up to my eyeballs and am trying my best, today CL finance have issued a Warrant of Execution to take goods, total to pay £200ish and o/s £7,000 ish. What do i do, i think its for EGG CC.

Can someone advise me what to do, i cant afford the £200 ish in one go. what do i do. I tried to call the number on the letter.

I have looked at the reasons behind a WoE and it says you have to have defaulted on an agreed amount or missed 2 payments. I havent had an agreed repayment amount from what i can remember.

I know someone on here will advise, i am desperate. The furniture isnt mine its my ex partners, but i cant prove it.

    Im not sure what to say just at the moment.

    But if they wish to take goods, i assume you defaulted on this (failed to make 3 months of payments), they obtained a CCJ from a court which you didn't defend, and you then failed to make an agreement to pay a bailiff. I believe only after all that can a bailiff be issued to start taking goods from the house. If they have not yet done all of the above can you explain more about this debt?

    I cant remember a CCJ being issued for this debt, if it was it was some time ago. Its with CL Finance and i havent got an agreement with them. I had a card pushed through the door and i spoke to a lady who said i had to pay £122 which i did and we didnt eat for the rest of the month. I was told someone was going to call me they didnt. I rang the lady again and she said she was busy and would call me back (just before xmas) she never did. Now today i have received the Warrant of Execution. How can they say i have defaulted on payment when none was or had been agreed.

    I will admit i have buried my head in the sand for a long time and this is the kick up the backside i have needed. I have a child under 16 and am struggling big time. I dont know how to handle this or what to do. I havent got £200ish pounds to stop this. Its Saturday and the offices are closed. I have until the 14th to sort this

    I have checked some things out on here, apparently i need to get a form from the courts, but i work full time, sometimes 7 days a week. Will they (the court) accept a reduced payment, i know its not up to them, but what do i do. They cant make a decision can they unless they have the form, but what happens while this form is being processed, it will take me past the 14th.

    My child is asking whats wrong, what i want to say is your mother is a stupid stupid person and should be more responsible, but havent.

    Am at my wits end.

    Awww modger you are not a stupid stupid person.

    Yes you might have ignore paperwork when you shouldn't have done but we have all made mistakes.

    I don't know about warrants of execution, I think you need to find out if there is a CCJ on the debt though. Have you old paper work you can look through? Can you recall CL finance writing before?

    You also need to read up on baliffs. They absolute key thing is not to let them in to your house, not to open the door to them. If necessary talk to them through the letterbox!

    You need proper advice and I think it would be best to try to get to the CAB at the start of next week if you can.

    Have you had a copy of your credit report - again it would be really good if you can get this asap. You can sign up for a free trial if you have a CC or if not you can request a postal one for £2 (I think it usually takes 4-5days to come).

    When they talk about defaulting on the agreed repayment they may just mean the original monthly payment/minimim payment you originally agreed to pay to the creditor (be that egg or whoever).

    Hopefully someone else will give more specific advice soon.

    Thank you, am just worried about them taking stuff that isnt mine. So i dont have to answer the door to the baliff then?

    i will call the number i have got for the court on monday and see what he says. If i managed to borrow the £200 ish would that stop the WoE and buy me some time to set up a payment plan with C L?

    What are they like to deal with? does anyone have an address for them as i dont want to speak to them over the phone, would prefer to deal with them in writing. Would you recommend i ask them for a copy of the agreement then at the same time, recorded delivery?

    Now, you need to be straight with us here, totally straight out.

    Have you ever borrowed form these people? Is it a debt you owe or is it one which you really have nothing to do with. Forgive me, but you seem to deny that you owe it and then you write about getting money to pay it off. The reason you need to be straight with us is that if you don't owe it, then you should not pay it and you have to do some work to undo whatever has happened. But if you do owe it, you need to deal with it.

    Either way, you will get good advice here. But firstly, no one wants to give the wrong advice and secondly, the wrong advice will cause you far more problems in the long run - if you do owe it, but you act on advice which assumes that you don't owe it and you set about getting a CCJ overturned, you will have a whole heap of trouble you could do without.

    Have you posted your SOA on here so that we can see if there is anywhere that you can make savings that will help you to offer the payments to your creditors? What is your employment situation or are you not working at the moment? I have been where you are and there IS light at the end of the tunnel sweetie so ***hugs*** you will get there, and taking control will mean that you begin to sleeo better at night and not be a stressed out Mum anymore. x

    If possible can you post a copy of the letter and the warrant- I suspect this is just designed to scare you (doing the job) and these are just threats to what "may" happen.

    I may be wrong but i think You don't HAVE to let them in if they don't have a warrant.

    Hi there Modger, just to clarify has the letter you have received come from the court (headed Notice of Issue of Warrant of Execution)?

    Assuming it has you can make an application to suspend the warrant and vary the judgement (pay by instalments) to the court.

    You need to complete Form N245 and there is a £35.00 court fee to pay unless you are in receipt of any benefits or on a low income (see here for more info).
