Acer computers / Comet

Hi everyone

I purchased an Acer desktop from Comet in March 09. In October 09 it developed a fault. It has now been sent back to Acer 3 times. With the same fault.

Comet say that they will not refund/replace the unit unless it has been sent back 4 times!

Acer have had the unit since the 11th December, and after numerous phone calls to their India call centre & empty apologies ( I must add the staff there are polite and courteous but don't have a clue what they are doing, just reading off scripts. etc)

I was told by them that if they can't replace it within 30 calendar days then I will get a replacement, so to call back on Monday (11th Jan)

Low and behold this morning I got an email from Acer saying that my computer is ready for shipping!. They are playing games.. if it had been left till Monday I would have hopefully got a replacement.

I tried to argue with a manger from Acer that in total my computer had been with them for like 50+ calendar days with the same fault, but he says that it does not matter the day count is per repair and not in total

I just hope that the fault has been fixed as the last two times I have had the computer back....they had replaced various parts but the same fault still remained!.

As you can imagine I am tearing my hair out and I just want a refund now! I have lost faith in the brand & I understand the onus is on Comet but if the computer comes back seemingly ok, then I guess I will just have to put up with it? as Comet will not want to know as it has been repaired

    Under SOGA a item must be fit for purpose and if a fault develops that is part of an inherent fault from manufacture then the item must be repaired replaced or refunded at their choice .(slightly condensed version). There's no stipulation on how many times an item can be sent back for repair in theory they could keep doing.


    It gone Six mounths so according to SOGA its up to you prove that its unfit for purpose Or that waiting for the item to be repair is a serious inconvenience to your self as they repaired it i suspect you'd have to wait to see if fails again, both of these routes I suspect would take a court case before they'll listen.

    Personally I would wait and see if fails again. Then chase them up on there "it must have gone back 4 time first" thing.

    If you really unhappy with the item write recorded delivery to both the store and head office stating that your unhappy with the item and believe its unfit for purpose list faults, date. Don't get emotional in the letter just plain Facts. Tell that if they do not replace or refund then you'll consider court action, but I would speak to a solicitor at one of the free advice centres first before taking court action as I'm not sure if you have a case yet.


    Remember to back any important data which everyone should do anyway.
  • the network nerd who sorts out our PC's at work is extremely anti ACER, he actually excludes any ACER products from his maintenance contract.
    Couple that with bl##dy comet and I really feel for your situation :(

    Did you buy with Credit card? if so advise card company quote section 75 and joint liability etc and they should sort

    I had a failure of a scanner a few years ago from Comet, local staff did not want to know contacted HO in Hull and problem sorted prety damm quick. Problem remains with retailer not manufacturer so its up to Comet to sort

    I have Acer from Comet and so far so good.

    thanks for the advice guys :)

    I will wait and see if the computer is fixed when I receive it within the next day or so. If the problem still remains then I will have to look at all my options as I am not going to sent it back to them again, only for them to hold onto it for another month

    yep I did pay with a C Card.

    I got an acer last year. The battery life is approx 3 minutes. I rang up but the battery wasnt included under the warranty. Stick with Dell and Lenovo me thinks
