got 2 letters yesterday from b o s about our claim
one of our claims was on ou joint account for £3140.00 plus interest

been unemployed twice last year for about 6 months in total still not working at present my wife doesn't work either looks after our 3 kids
first letter on our joint account ;having read your account carefully we are satisfied that the fees were applied correctly ,however under your current cicumstances we offer you a payment of £126.00 which amounts to fees debited to your account between 31st october 2009 to 6th jan 2010 any other fees on this account over the next 3 months will be cancelled and £35 token of goodwill paid into account
personal account was just about the same offered me £476 from 16th sep 2009 to 6th jan 2010
satisfied that the fees were applied correctly ,they don't offer 3 months on this account

With regards to Financial hardship, the question is not whether you should accept it but whether the money alleviates financial hardship by allowing you to pay arrears off. Does it?
Furthermore have you spoken to companies that you are in arrears with to see what they can do for you?
Your immediate concern should be how much it helps rather than what Martin will advise in 3 weeks cos 3 weeks could make your hardship worse without the money.

I agree with natweststaffmember - the real issue to remember is that by making a financial hardship legal challenge you have asked the bank for assistance in alleviating your difficulties. If their offer does this then accept it. And with the limited information you have given in your post it sounds like a fair offer. Remember, the Ombudsman looks at what is fair and makes a recommendation to the bank to resolve the complaint, they are not there to make the bank fix your problems.
