Car Accident - Injury Claim?

A few years ago, in the rush hour, i just VERY LIGHTLY bumped an Audi TT in the rear. I confirm my speed was not even being registered on the car speedo. The woman got out as i did, we both inspected the bumper that had scratch marks from normal everyday use. She got on the phone to her husband, chatted a while and we exchanged details. Got home, rang my insurance to tell them what had happened. They asked if it was my fault, as we were all moving in one direction and i had bumped her rear, i confirm that yes, it was my fault.
I did not hear anything for many months until my renewal date came up. On my renewal document i saw a comment relating to "accident at fault date etc". I immediately contacted my insurance Co (MoreThan) who confirmed the woman had made a claim for a) neck injury with Dr certificate and b) re-spray to bumper with car repair shop inspection document.
I was absolutely stunned !!!! the insurance said that with a medical certificate there was nothing they could do !!
So go and see your doctor and claim against the other driver. That's the kind of society we are in.
That is the kind of society we live in this is true, however the you did damage her bumper, she would have claimed for this no matter what. If you had paid for her damages at the scene of the accident then this would not have happened. Im not being funny if i hit someone in the back, there bumper was damaged, i would offer to pay for a new bumper and for the spraying of the bumper and settle the claim out of my pocked. As my premiums would go up a lot due to a claim as i am young and drive a high insurance group car.
You offered this or not im not sure, if she claimed for that bumper or the bumper and her injury's. It would make no difference, it will still be a 100% Fault accident TP costs paid out. The payout is not important, whats important is the fact that a payout is made. Back to the this is the kind of society we live in, its clear in the increase of premiums over the last 10 years, that since then a lot of people claim even on very small accidents with hardly any damage. As people see it as free money, this is due to many factors but mainly its the no win no fee accident injury lawyers faults that our society has been shaped this way.
My 2 cents, your right its getting pretty mess at the moment and premiums are going up and up and up. Its worse for the younger driver rather than the experienced drivers however i believe that if someone has caused damage to your car, you should get the damage fixed. Via insurance or TP that's not an issue. If you feel that the damage was massive and in a lot of pain then it is best to claim from TP insurance.0 -
No darling piglet. Imagine rush hour traffic bumper to bumper and no speed at all. That's what happened and she just tried it on and succeeded.

You mention some mild steel bike rack dented on your own car. That must have been a shock in itself and nothing compared to the light "bumper to bumper kiss" i experienced.0 -

I will just say, in the accident I was in I found out just why this is a bad idea, from the outside of my car all either of us noticed initially was a dent and the boot wouldn't shut, thought catch had been twisted - turns out my boot pan was dead and car twisted, car's a write-off! Didn't realise until we got home, thnakfully I had her details. That wasn't even high speed (though was more than I realised at the time!).
My point is, often nowadays people won't take that in case the damage is worse than expected. Plus technically if you didn't declare such an incident and your insurance found out, they can invalidate it I think.
I agree though that ocassionally people really can suffer from even the most minor bumps, but is it's just a bmper kiss she probably was trying it on. Not 100%, but very likely.0 -
Sicne the accident, my car has been assessed by my insurance and have classed it as a 'unrepairable, Cat D' undriveable' and have quoted a figure. Its not a write-off and I dont have to buy the car back.
The other party has admitted full liability, so apparently I'll be recieving a cheque in the post to get my car repaired (it is driveable!).
On the other side, gradually as the weeks went on my lower back and neck felt straining and sore, I was losing sleep, so I did get to see a Chiropractor last week, who confirmed that I had muscle spasm and gave me treatment; I am due to continue this at my cost.
My insurances' claims dept did speak to me about the injuries / loss of earnings and want to pursue it, so I said thats fine - up to them, they are the experts. So she just said to keep a note of any expenses (chiropractor) and they are supposedly going to have me be assessed by one of their medical examiners... not sure how that will go if I'm already recieving treatment.
But everything appears to be looking up. Thanks for your feedback guys; its interesting to see the varied comments and I can totally see from both sides of the argument0
