  • TBH its a pain but I think a new flat is the way forward, I still want to speak to him, I don't want to be tarred with the brush of being intimidating, I think I am a perfectly nice person.

    I also want a reference otherwise I'll be !!!!!!ed finding a new rental property! Everyone wants references from your previous landlord here.

    If we could move earlier than March 30th, this would make finding somewhere else easier, and more appealing to the new landlord!
  • You can move earlier but you need to pay the rent timed with whatever the payment-period is on the original agreement. so if you pay the rent on the last day of the month you could inform the landlord in writing that you are moving out at he end of February at the end of this month, for example.

    I'd write to the landlord asap letting them know that you appear to be being blamed for noise made by other tenants on the same floor and that you were NOT intimidating or abusive to anyone when trying politely to resolve the issue, just to try and extract a decent reference from them.

    How long have you lived there? Can you still get in touch with a previous landlord for a reference? Some landlords actually prefer this, as current landlords may give a falsely good reference in order to get rid of a tenant (obviously not the situation with you but I'm just trying to illustrate that a lack of reference from current landlord might not be a huge problem).

    You could try reminding landlord that if he gives a false and misleading reference, then you will sue him for libel. Only go down this route if you can find a firm of solicitors who will take the case on a no win/ no fee basis......otherwise you could land yourself with a bill of £50k.
    Othewise the sooner you move out the better.
  • I have a written letter from our previous landlord who we were with for a longer period....so good if need be.

    I've seen a property we might go and look at anyway.

    I've spoken to my landlord and it appears everyone has been complaining about everyone else..still unsure why we were being evited though....if I can speak to all the residents and they are happy we can stay if we want to and they will cancel the eviction notice, which might be an idea for the time being.

    I've already spoken with three of the four other flats, just need to do crazy lady flat and we're good :o

    Thus far no one has had a problem with us, so I'm guessing it is just her.

    I just advised everyone if we are making too much noise, then please come and tell us, we don't make noise after 11pm as I commute and am usually in bed anyway, (which is the period of time in our contract that noise is not tollerated)

    Fingers crossed I can get this sorted, I personally do not need the stress at the moment!

    Your landlord has no obligation to give a reference at all. OTOH if he wants you out with the least fuss he would be well-advised to give a factual reference, eg rent paid on time, etc.
    No reliance should be placed on the above! Absolutely none, do you hear?
  • Yeah our deposit is in a deposit scheme holding fund etc.

    We moved in Jan 30 2009.

    But I don't think that applies as we had all the info.
