Is this legal?

Hi all. Quick problem i hope someone can answer.

I pay my credit card online, mostly so that i can pay more than the minimum due, but also because i get paid four-weekly rather than monthly.

My card provider posted a statement to me at the end of December 09. It states my next payment is due by 1st Feb, and confirms receipt of my last payment (made on December 12th). All fine and good.

BUT..... I have just had a call from the arrears department demanding immediate payment of minimum amount plus £12 default charge!

Can they do that?

    Doesn't sound right.
Did you tell them about the statement?
    What did they say?

If you have it in writing I'd say you are fairly safe, and need to talk to them to sort out the error.

From what you've said it sounds like they've made a mistake.

However, is it possible that at some point you've paid twice, four weeks apart, within the same statement month? Then not made a payment by the due date?

Yup, would bet a pint that OP has made 2 payments to 1 statement and missed a payment to the next one.

If they can post back with statement dates, statement due dates and payment dates together with payment clearing dates will probably be the case.
