Carcraft / barclays : S

Hello All,
I am new here if anyone could please help me or point me in the right direction I would be very greatful.
The problem started in August 2008. My partner bought a car which he needed to get to work. Being brassic he bought it from Carcraft.
Because it was a little car and the loan was for less than 5k, he ended up gettin two loans, one from Barclays and one from a random company. The Barclays one was for 5 years, and the other loan was for three.
At Carcraft (or Carshaft as we call them ; )) we went into the little room so he could sign the paperwork. He explicitly told the woman several time he did not want PPI and she stated he would not have PPI although recommnded he did.
Low and behold when he started statments from Barclays he had a £6 monthly PPI charge. I noticed this and told him to contact them but he didn't
Now he has been made redundant and attempted to claim on the PPI. He was told it only applied if he died. He would never have agreed to this.
He has written to cancel it but I have two questions:
1. Can he cancel it? I havent read the fine print but is it likely?
2. What are the chances of him claiming back all the monthly PPI payments.
How will the fact it was sold through carshaft affect this? I actually have a form in the carcraft ladies handwriting stating that she recommended PPI but he declined.

Spout handle lid of metal whats inside the ...........singing kettle.:p
Sorry just had to do that takes me back to when the kids were wee, think I can still sing all the songs.
Welcome SingingKettle, I would say you have three good points to claim on. 1/ Carcraft document declining ppi, 2/ Explicitly told carcraft didnt want ppi 3/ only paid out in death which wasnt explained at the time even if you had wanted it.
I'm sure Di or Marshallka will give you better help. Good luck and welcome again.0 -
Hiya and thank you, my wee brother loved the show and I randomly got the song in my head when I was signing up :rotfl:
Do you think we should approach Car Craft or Barclays in the first instance?0 -

I would think your claim would be with car craft as they did the paperwork but I will pm Di and Marshallka to get them to help you.

Hi singingkettle, I think you certainly have a case for misselling and proof also to back it up.singingkettle wrote: »Hello All,

You need to write to Carcraft if they actually sold you the Loan and PPI and I would enclose the proof of you declining also and then you give them 8 weeks for a full and final response. Don't forget to send everything recorded delivery though so you have proofs.
ALso where he tried to claim on the PPI and it only covered death so they say, have you got any paperwork with the terms and conditions of the PPI at all?
