  • my daughter in law sent a request for cca to bryan carter after she received a letter from his company she enclosed a 1..00 postal order he has now returned postal order stating that she must request cca from original creditor even though the debt was passed to his company can anyone help out as what to do next thanks ;

    Send it straight back to them . It is their duty to pass it on to the OC.
    Send it recorded delivery .

    As I read it , if BC now own the debt then its up to them . It's a bit contradictory this new guidance , seems to be yet another example of re-interpretation if the same old words.
    Write to OC, but mention that the original request was to BC , that way if OC mess you around as well, you have proof of the start of the whole process .

    Good start. They'll come back to you with one of three answers - they'll either accept your offer (doubtful), demand full payment (semi-likely) or come back with a counter-offer (my guess). Either way, thats when you make your choice. If they accept, pay up quickly - just make sure that the letter they sent acknowledges that the amount is in full and final settlement.

    If they refuse and counter-offer, decide whether the counter offer is acceptable - bearing in mind that if they take you to court, it'll be for the full amount. If they counter with, say, £600, I'd be tempted to write back including a cheque for £450, reiterating that you really can't afford more and asking if they'll consider the enclosed in full settlement. It might work.

    If they demand the full amount, come back here. You already acknowledged that you owe it and that you can afford it, so you're really just trying to get off light. Nothing wrong with that, although I'm sure some moral crusaders will disagree with me.

    When I was in your situation, I made promises of payments every fortnight, mostly because thats how often I got paid. The other advantage of fortnightly payments though, was that by the time they wrote back telling me how unacceptable my proposal was, I just wrote back to them, basically saying "Sorry, that's all I can afford. Here's my next instalment". Repeat until paid, basically. They knew they were getting their money, and I knew they were just blowing off steam because they were never going to take me to court while they were getting regular payments.
  • I got a letter from them this morning, they work in conjuction with Fredrickson Intl.

    As they ring me every day the cats !!!!ed on it and it went in the bin.

    You have confirmation that it was received by him? If so, report him to the Solicitors Regulation Authority, Trading Standards, the Financial Ombudsman Service and the Office of Fair Trading.

    If he now 'owns' the account, he's trying to fob you off - it's his job/responsibility to get the information you've asked for.
