help with bryan carter & co

hi i just got a letter from bryan carter & co threatening to take me to court after looking at this site http://www.consumeractiongroup.co.uk/forum/debt-collection-industry/93189-bryan-carter-still-exist.html im a bit worried the amount is about £800 and they want it on the 11th or there taking me to court....how serious are these people if i was to pay these people -- i have other debts also .. how would i pay them?? cheque?? how would i send it? please could some one point me in the right direction?? i don't want to end up paying the debt then them telling me i still owe them the money....thanks!:o

    Pay them by cheque if you owe it and you can afford it. Keep your cheque stub and your bank statements

    and do you think they will agree to the 23rd of febuary, thanks again for your help .. the more i read on them i think it's time to stop running from it and face up to my debts

    lol .. if i was to give them say £100 when i get paid token then payment the rest next month what do i say to them shall i ring them or send them a letter

    To Whom It May Concern

    I do not acknowledge ANY debt to your company.

    I require you to supply the following documentation before I will correspond further on this matter.

    1. You must supply me with a true copy of the alleged agreement you refer to. This is my right under your obligation to supply a copy of the agreement under the legislation contained within s.78 (1) Consumer Credit Act 1974 (s.77 (1) for fixed sum credit) - your obligation also extends to providing a statement of account. I enclose a £1 postal order in payment of the statutory fee.

    2. A signed true copy of the deed of assignment of the above referenced agreement that you allege exists.

    3. You are notified that you are obliged to supply these documents, whether you are the original creditor or not under S189 of the CCA 1974.

    Non-compliance with my request is a criminal offence under the above Act and will result in a report being submitted to the relevant statutory authorities.

    As you are aware, a credit agreement that is not properly documented and signed by the customer is totally unenforceable under the CCA and therefore is a complete defence to any court claim that is issued.

    Take note at this stage, that any legal action you may contemplate will be both vigorously defended and contested.

    What was the debt for? Overdrafts don't have a CCA.

    Could you possibly make a reduced full and final settlement offer?

    Do they say they WILL take you to court or they MAY?

    hi thank you for getting back to me.. basicly there saying that they Will go ahead ... really i can afford £300 this month and 500 next month... would they go for this? if so how would i ask them for the time as i said the money can be raised on the 23rd on this month. but they are asking for the money on the 11th of this month... again i hope you could help me out mate... and thanks for getting back to me
