Section 75 or Airline refund?

Hi All,

I was one of those unfortunate to have flight cancelled by the airline 1hr before departure recently.

Now I am trying to seek a refund (I do not wish to rebook). I have two options and wonder if anyone has any experience with them.

1) Dial the riduculously undermanned phone number and get continually dumped off the line (0844 number!) in an effort to discuss the refund with BA. (Note for some stupid reason the refund option on web is greyed out).

2) Make a claim via section 75 (booking was direct with BA online with Credit card both legs of the journey are well over £100 each.)

an additional question is if I claim via 2 will I get back all the money. If I claim by 1 ba slap on an admin fee that covers the TAX they take on the ticket. This is almost criminal in my view.

any ideas.

    Section 75 holds the supplier and the credit card company equally liable - which means you are entitled to claim from either and you don't have to approach the supplier first.

    Credit card companies will tell you otherwise because it's just easier for everyone (maybe not you) if you go to the supplier as if they're reputable will often simply offer a refund.

    Legally speaking however, you can go straight to the credit card issuer with your claim.

    Also - in regards to your query about BA's admin fee - that's a very seperate charge BA are making for offering you a refund - it's got nothing to do with Section 75.

    So in theory, if you go to BA - you'll get a refund (with their fee). If you go to the credit card issuer - you'll get a Section 75 "refund" (I think it's probably more technically known as a charge-back because the cc issuer has to charge the money back off the supplier) and there are no admin fees for Section 75 claims.
  • Surely if you have to have your flight cancelled 1h before departure, due to no fault of your own, BA has the obligation to refund you the money without charging you?

    What was the circumstance behind the flight cancellation?
