I have received a letter from each of the banks I am attempting to claim charges from telling me they are not upholding my complaint nor refunding the charges. They tell me that if I remain dissatisfied with their response I should take my complaint to the Financial Obmudsman Service. Also, if they do not hear from me within eight weeks they will consider my complaint close.

I am unsure how to words my letters to the FOS or the banks. Can anyone offer advice please.

    Your claim to them was based on an argument which is now no longer legally effective, since the Supreme Court decision.

    Any new claim would have to be on the basis of new legal grounds.

    Various sites are working on this but templates are not expected until 3rd week in January at earliest.

    Keep checking on this site for an update and sign up to the MSE newsletter, where news will be posted. This should hopefully be within the 8 week period. It will entail a lot more work on your part however.

    I advise you to wait until further guidance is available, also do not contact FOS in meantime either.

  • Can we clarify what argument you used?

    Orc, the letters being sent out are templated so some people may have used UTCCR 1999 reg.5(1) so they may not have been old arguments if they had specifically used that argument.

    (please don't leave it another 2 years before posting again :))

    Have you managed to have a read of the MSE articles on reclaiming bank charges yet? Lots of good advice there such as this:

    A. They have eight weeks to deal with it and it's likely they'll be swamped. When your case is dealt with, it's likely to be thrown out if your argument was based on the premise of the OFT's original case, that the fees were disproportionate.

    Yet there is nothing stopping you complaining a second time based on the potential new legal arguments and you can always complain to the Ombudsman if you don't like your bank's response, and this is especially worth doing if you fit any of the Ombudsman's special criteria (see below).
