Car with finance still owing, want to get rid need help

I bought a used car several years ago on finance. After paying every month fine for year and half or so i became ill and have been unable to work since. I was forced to take payment protection when i bought the car but they refused to pay out when i made a claim. I then contacted the company to try and reclaim the ppi (which was quite a sizeable sum). The company never got back to me and after a while it got to the point where i could not afford to pay. Since then the finance on the car seems to have been passed from pillar to post with me not knowing what is going on. An hpi check says the finance is still owing to the people i bought the car off but when i try and contact them they say it is nothing to do with them. To cut a long story short the car is laid up in a garage not running and i want to get rid of it, probably by scrapping it but am i allowed to do this with the finance still owing?

please note i know i still owe money on the car and want to pay it off but am not in a position to.

Any help would be greatly appreciated.

  • Don't scrap it, as if it is on finance, with monies outstanding, then the car doesn't belong to you, it belongs to the finance company until it is fully paid off.

    I'd put a bit more effort into getting your PPI refunded, and also a bit more effort into finding out who you now owe the outstanding finance to. When you find out, try to come to some sort of payment plan with them, or if you really cannot afford it, ask them to take it back.
    Depending on how much of the finance you have paid off, you may be able to hand the car back and be rid of it, but I'm not sure if you need to have paid half, two thirds or some other fraction of the finance - someone with more knowledge will be along soon with more info.

    Find the complaints address of the PPI company and send them a recorded delivery complaints letter. At the end of your letter inform them that if you don't hear from them within 8 weeks due to contacting them previously (put the date if you can even if it's approximate) you will refer your complaint to the Financial Ombudsman Service.
    I'm not cynical I'm realistic :p
