    The parcel carriers were under a great deal of pressure over the past couple of weeks and some of the tracking data has been entered late (and by some couriers not at all). I don't think you can use this as evidence that the supplier lied to you.

    Monday before NYE was not a working day, it was a Bank Holiday - they could not despatch on that day because NO parcel couriers were collecting that day (and the vast majority of warehouses were closed). So, basically you expected next day delivery, after a holiday period on the first working day back, where there was a huge amount of backlog volume in the parcel networks, along with snow, adverse weather, vehicles in wrong locations etc etc. Also, New year's eve is not a normal working day for couriers.

    I understand that non of those issues are yours, they are the suppliers and the courier companies. However a realistic customer would take these issues into consideration, and think that they would be really really really lucky to order on a bank holiday monday, get an item pick, packed, dispatached the next day by the supplier and delivered to you on a non full working day.

    And I don't think that "I ordered it on Monday because I especially wanted it for NYE and I felt let down" [because they didn't have the superhuman skills necessary to get it to me for when I wanted it] is a valid reason for keeping items that you haven't paid for and are not yours.

    You should email them, tell them you have two parcels, and let them arrange for collection from you.

    (Apologies for any sarcasm, have spent a lot of today dealing with enquiries from people who can't understand why deliveries haven't been made when they live in an area where the roads are closed and they tell me that they haven't been out of their house for 2 days!!)

    As posted, contact them. They may ask you to send back at your cost but you should refuse and tell them you are happy for them to have the goods but they must either send a prepaid postage label to you along with your petrol and time costs (within reason) to get to a post office OR send a courior to collect the item at a time convenient to yourself. Also state that if they do not do this within 6 months you will consider the item unwanted and dispose of it;)

    in 75% of cases (lower value items usually) they do not bother and forget about it. In this case keep the item and use it after the 6 months.
    Back by no demand whatsoever.

    Just wait until they ask for it back, if they don't then ebay it or something.
  • OP have you tried ringing the company since receiving the 2 packages to resolve this?

    So you want to keep goods that you have not paid for and that were sent in error.

    I guess it depends on what morals you have really but I think you want us all to say 'go, on keep it' anyway. So it does not actually matter.

    As for obligated to return them: if they trace the package having been sent but not paid for they could then recall it, if you have worn the goods they can then ask for payment of them. If you refuse then it is possible that they could sue you through the small claims court for the amount as they will have the proof of delivery that you signed for so you cannot say you do not have the goods.

    Wasn't DHL was it? My supplier sent me goods (proof on picking note) but they were not even entering info onto their systems during Xmas and New Year due to 'adverse weather conditions' so the dates showing were incorrect on their site. They were putting dates that showed they were delivering in line with what they were contracted to (IYSWIM) so I would take all online tracking details with a huge pinch of salt in my opinion. What dates are on your picking note?

    This is what i did.Rang them freephone (of course,got caught out once before trying to return stuff and I got NO thanks so now only make minimum effort)
    Told them i didnt order it (they couldnt grasp that) told them the only way they would get it back was if they sent me a freepost label (they couldnt grasp that either),and so eventually they told me to keep it and i asked for a reference number.That way I got to keep something i really didnt want but at least i didnt have to worry they would come back to me.
  • In answer to your original questions, keeping the extra one is morally wrong obviously, as it is not yours. Whether you are obliged to return it rather depends on whether they can prove you received it, if they can, then they may insist you send it back or pay for it. That's assuming their system actually knows they sent you two.

    Glad to hear that you are going to ring them. If the note inside the parcel says 28th Dec then it might be that the delay was due to the courier and not the company you purchased from. In this instance you may wish to cut them a bit of slack in view of adverse weather conditions!

    DebtFree FEB 2010!
    Slight blip in 2013 - Debtfree Aug 2014 :j

    Savings £132/£1000.
