I have just received a bag I bought off ebay. I knew it was a fake but bought it anyway it looked good on the pics
http://cgi.ebay.co.uk/ws/eBayISAPI.dll?ViewItem&item=9331678191&rd=1&sspagename=STRK%3AMEWA%3AIT&rd=1
The description shows a padlock that should have been present along with the serial number which isnt there. Consequently I have emailed the seller and am waiting for my reply. What are my rights and can I also claim back original sending and return postage costs as they are £8.50 each?

How did you pay? Paypal?
You can file an item not as described dispute. You'll be required to post the item back to the seller (at your cost) and, in theory, you'll get your money back. However, that's how it's supposed to work, but you've already made an error by attempting to deal with an individual who, by your own admission, is selling a fake. If they'll do that, I don't think they'll have any problem with holding on to your money. I don't want to sound harsh, but why pay £46 for a fake?
Someone posted on here several months ago having (twice) purchased a counterfeit bag. In the second case, they retruned it, but the seller refused to accept delivery, or wouldn't pick it up from the depot, so they simply couldn't return the bag. I have no idea if they got their money back. I doubt it.0 -
I'm a little confused here. You say you knew it was a fake and yet in the listing heading it says AUTHENTIC. Surely that's a case of item not as described?0
-
The seller has clearly stated **Authentic** on the listing, how did you know it was a fake, and surely this is breaking ebay rules? Passing off a fake back as the real thing?0

Selling a fake on ebay is against the rules, full stop, however you describe it. Ebay will quite happily throw the book at them.My TV is broken!

Edit: refunded £515 for TV 1.5 years out of warranty - thank you Sale of Goods Act! :j0 -
I assumed the OP knew it was a fake because of the price. As everyone else has said, selling a counterfeit product is against ebays rules. Unfortunately, if they're prepared to break that rule, I don't think they'll have any problem breaking other rules (e.g. refunding the OP's money).0

Its also against ebay policy to knowingly purchase counterfeit items, its a complicity thing!Live each day like its your last because one day you'll be right0

Hope you paid with paypal, OP.My TV is broken!

I have to say I was confused that they said authentic on the description. The fact that I paid only about £60 for an item that usually costs a few hundred pounds gave it away as a fake though and also all the feedback from the seller is private! However I only checked all those details after I bought the bag. How does ebay handle these problems ? By the looks of the replies I have received so far I have a case to complain about! And yes I paid by paypal0

Am I looking at the wrong item then?
From the link you have provided the sellers feedback isn't private.
Sometimes it's important to work for that pot of gold...But other times it's essential to take time off and to make sure that your most important decision in the day simply consists of choosing which color to slide down on the rainbow...0 -
I think the OP has confused the bidder's IDs being kept private with the seller's f/b.
I only exist in my own mind - if you can see, hear or read me, you are a product of my imagination.0
