I spoke to my adjudicator today and he has has to pass it on to another dept as Norton finance have told the FOS that the FOS are not authorised to make a decision as my loan was in 2004...
Help what does this mean ! have i totally lost the case ? are norton finance a bit worried to pull this stunt ?

Hi there
If Norton was not governed by GISC (General insurance standards council), the FSA taken over in Jan 2005, then normally the FOS are unable to deal with these complaints.
If they decide not to do this, then pursue through the insurer underwriter instead, as they should be covered by the above anyway.
The lender will or should have details of the insurer.
Many of us have been in the same situation, and have had to go this direction.
See what the FOS come back with first and we shall take it from there, as there are ways around this to get your money back.;)The one and only "Dizzy Di"

This is exactly what happened with my complaint against FP in that FOS got it to an adjudicator and it was only then that FP told FOS they did not have jurisdiction and FOS listened and dismissed the complaint. When I complained to FOS about it they said they can actually consider any complaint but if a firm says that its outside their jurisdiction and it is the case then there is nothing they can do.
Holly22 i am so sorry about this and know how frustrated you must feel but they may give you the option of making the insurer/underwriter responsible for the sale.0 -
the insurer was Cassidy davis ins group which has now changed to Jubilee servcies 2 monthes ago...

Holly, I won against Jubilee a couple of months ago and they were quite fair TBH. It was not a misselling complaint though and was actually a rebate complaint BUT I know that FOS were accepting complaints against insurers for misselling (although do not have any feedback as yet from here) and I know that the manager dealing with my rebate complaint said they did not know how long it would be before they start to accept liablility for selling.the insurer was Cassidy davis ins group which has now changed to Jubilee servcies 2 monthes ago...

Have FOS advised you what to do next and who to write to. I know how frustrated you must feel as I went through it myself after being before an adjudicator twice against FP. Just hang on in there and do not give up.0 -
