I got a samsung tocca utral off ebay was mint working for about 4 weeks then the keys stoped working ... So found a repair center near me and took it in for repair they did it under the warrety got it back said it was a softwear problem.. used it for a few days and it started doing the same then just went off and did come back on pluged it in for change nothing... found a 2nd repair centre its in there now and they said it needs a part ...

How long do i have to wait before i can ask for a replacment handset ?

Is the warranty officially transferable, or have the repairers assumed you are the original purchaser?
If not you have to wait until the manufacturer/repairer decides, out of goodwill, that he is willing to replace it. No harm in asking though, except of course that the repairer may be alerted to an invalid warranty claim.

You could ask the ebayer you bought it from what he is going to do about it.
