The FOS have introduced some filtering to capture complaints before they get to an adjudicator where there is either no case to answer, outside of remit or an issue that can perhaps be easily resolved without the need to go to adjudicator.
vexatious complaints also dont get charged either and if you have already complained before, you dont get a second bite at the cherry with the FOS unless new evidence has come to light that could change that decision.I am an Independent Financial Adviser (IFA). You said the FOS ''will filter the complaint out and reject it'' but clearly you cannot know this. The FOS is writing to all claimants offering them to submit alternative arguments for bank charge complaints other than the ones originally given, rather than rejecting the complaint outright.0 -

Has noone yet chanllenged and had their money back from the banks since the end of the test case??
I heard from a friend who works at Halifax in the claims department and have been told this week alone halifax has paid out over £50,000 to people challenging the charges on their accounts.
This tells me there are people who have already rechallenged the banks and won already.
Is noone going to share this info on how they got their moeny back ???

£50.000 is nothing to the banks,this will certainly be for hardship claims,probably only fifty people, or less have been paid if that figure is correct,missed direct debit charges,very odd,theres no pain so how come the big gain,i.e £39.00 for a letter0 -
I know 50,000 is tiny amount in terms of an international bank but i thought it was an intereesting point to share and to let people know there are still routes avaiable and that all is not lost.........
the way it was explained to me that was the figure that the local bank, for the area had to pay back to local customers.
the thing is this is all hear-say and cannot be proved, i never saw any figures and i only have the "friends" word on all of what i have said
how long is it likely to be before martin and his QC will have that new proposal drafted?? does anybody have any information or updates on this????0 -

Third week in January was the last I heard.
I think that could be delayed however as a lot of work is involved. However, that is purely a personal view..
As Chris said, keep checking all web sites.
The new arguments have to be relatively watertight as so much will depend on the banks reaction, then FOS and the courts.Please ignore those people who post on this forum who deliberately try to misinform you. Don't be bullied by them, don't be blamed by them. You know who I mean.

Apologies but if that person who you know has said this then they need to prove it by showing you a document or if need be if you can get a copy of the document then email site team. £50,000 may not be that much if it is based on ALL refunds at the branch depending on its location and the numbers of people who use it. For example, a village branch may not necessarily refund that amount but a centrally located city branch might do over the course of 12 months. Your friend needs to fill in the gaps better.0 -

It really depends on what the payments are actually being made for. I work in the complaints department of a bank and our average monthly good will budget is £40,000. But we don't deal with hardship challenges. And we are just one branch of customer relations, a small branch at that!Getting married 02.08.14
