Wow your advice is bad. If the OP's account is correct and he was driving along when someone pulled out too close to him and regardless of his attempt to brake he went into the back/side of the other car, that's definitely not his fault.

I had a similar accident some time ago, but the bloke pulled out of a side road and I hit him. Following a rather lengthy debate, I refused to accept liability as the insurance requested as I stated that the term "give way" means you can only proceed when safe to do so and that being approximately 20 feet away from the junction I did not believe that it was safe to do so thus removing all liability from me.
I'm sure they say that you should if required use the whole of the slip road to join a dual carriageway. I am of course assuming it was a dual carriageway and not one of those "give way" slip roads that are 20ft in length onto an ordinary road....In spite of the cost of living, it’s still popular :eek:0 -

we're all assuming because the OP hasn't told us where this happened or what kind of road it was. I don't think it was a dual carriageway though as they did refer to pulling into oncoming traffic.I was born too late, into a world that doesn't care

her friend still had right of way as he was on main road, dual or not so car coming of off slip road should have given way or adjusted there speed to join main carriageway safely really p***ess me off, people who cant use indicaters or get in wrong lanes at roundabouts etc maybe we should be required to take a test every 10 or 15 yrs0

Many thanks for the clear Advice Oscar the Grouch and everyone else. I did feel slightly ganged up on my the first posts i recieved.
I will ask exactally where this happened and let you all know. I don't live in the same area so don't know the roads, but i can say that considering it was a snowy day i know my friend would have been careful as he isn't a silly driver.
In regards to expenses his son has taken most of the impact. Luckily they work at the same place :-) and take it in turns to drive normally so getting to work has been ok. It's more of a pain in the bum than anything. As his son is now sole driver he can't do very much because everyone needs a taxi about and over the festive period had to stay quite sobre for this reason.
I think i was more mad because my basic assumption was you got a courtesy car from day one, as well as the fact the insurance company has been mucking him about from the start.
He's not a big one for arguing or being forward so has not badgered them but even he is beginning to lose patience, as you may be able to tell from my posts, i'm somebody who would be on the telephone everyday lol (gets things done faster, the more annoying you are the quicker they fix things to get rid of you) Terrible, but it does workI get what i want. That isn't because i'm a brat or spoilt. It's because i'm determined, i work hard for it and i achieve my goals!0
