Mobile phone contract help!

i really need some advice... i took out a contract which was the htc hero £35.00
i was having problems with the phone so the company offered me a phone which was like to like which was the the htc tattoo.
i recieved the phone and it was nothing alike.. the screen reso is rubbish... the software dont work..
i phoned up the company and they said i cant swap back.. but with my new phone the tattoo ink i had no box nothing just the phone!!!!
the lady said she will talk to the manager but they said the lady who swapped my phone would have to go on a training course as she mislead me with the phone she will not agree to missleading me i really need help!!
