Why do people feel the need to make judgement. Just tell him what he needs to know. for all you know his bother is telling the truth just be honest tell him that his bro is stuffed if Tesco are anit going to do anything for him, legally his not got a leg to stand on unfortunately.0

You could get the store to check their CCTV. Hopefully they'll have cameras in the stock room and would be able to see when the box was taken and where it was, then trace it back. If a returned item was put in the wrong pile then collected for sale, they would see on the CCTV.
Also, it might be worth him, or in store, getting them to look through the console's gamertag/setting history to show if it has or hasn't been used...i.e what games have been played, when, etc. That may be enough to prove he hadn't used it, or that he wasn't sold a new console.0
