Faulty phone

Hello and thanks for taking the time to look in on my problem

Bought a phone from CPW yesterday, the assistant opend up the box, and set up the phone for me (I didnt ask for this) I payed up and left the shop.

As I got out of the shop I pulled the phone out of my bag to make a call to find that the phone was dead

hmmfff I thought .... mayby its dead (the battery had gone) so I took it home and put it on charge ..... 30 mins later, the lights will come on and it gives out the startup tone (nokia phone) but nothing appears on the screen. Its now 4pm so I toddle back up to the CPW shop (2 miles walk) to find the shop is full and I dont fancy waiting as my daughter has a dr's appointment.

So I'm going back later today ....... will I get my phone exchanged ? or will they send it off for repair ?

I would prefer an exchange as I feel that I have bought a faulty phone - so when its returned, its refurbished :(

I'm going into hospital on thursday and wont have any means of staying intouch with anyone as I dont have a replacement I can use.

What do I need to say to get myself a replacement phone ? I really want to stand my ground in the shop and demand my faulty phone is exchanged but I'm not really good with confruntation. Any help or advice you can give me will be really appreciated.

    If the phoen was DOA then you would be within your rights to receive either a full refund or replacement. Don't accept a repair at this stage!

    FYI, you need to read your instructions regarding charging the battery. Most mobile phones require a full 12hr+ charge out of the box before use.

    In which case you can point the blame at the assistant for "setting it up".
    Back by no demand whatsoever.

    Much to my supprise, the nice young lady exchanged the phone with no questions :D I was expecting to go in to the shop and have to sell my soul for an exchange.
