im usually adding or offering advice rather than asking for it so i hope somebody can give me the info i need, i have a 2nd owner 4 year old mercedes benz diesel car with 60,000 very carefull miles on the clock, the turbocharger has broken, i have been told on a mercedes benz forum that it is reasonable to expect the unit to last for 150,000 miles or at least 10 years and they have suggested that mercedes benz should fix it for free and that i may have a legal case under the sale of goods act?, the car had the last service carried out by a friend of mine and all oil/filters were replaced as reccomended, i have only done about 15,000 miles in it in the year and a half i have owned it and it is due another service in about 3000 miles according to the service indicator on the dash, in short it cost me £13,000 and i didn;t expect to be spending too much money on it anytime soon, mercedes have quoted £2000+ for a new turbo, do i have a legal case to argue? what steps should i take to get the ball rolling?
thanks in advance for any help

You have no recourse with the manufacture as you did not buy it from them. You may have some recourse with the seller. Did you buy it Private or from Dealer. Secound cars are a bit of grey area when it comes to soga. Second hand cars are usually considered buyer be ware.

I think you will struggle tbh.

Whilst they may be good for 10 years or 150,000 miles I wouldnt say 60,000 is exactly a small mileage hence I wouldnt say its not durable.

If it had been 6,000 miles maybe.

The SOGA states the car should last a reasonable time, it doesnt say repair free, the reassonableness of any repairs would be based on age, price paid etc.

I am afraid I cant see you winning this here.

you bought it from a trader but you didnt say how long ago??
Most reputable dealers offer a warranty so you should investigate that route, but again it depends on how long ago you bought it, how lng the warranty is and the specifics of what isnt covered by the warranty

unlikley the dealer you bought it from would do anything now due to how long you have owned it. I would say its very unlikely that mercedes will fix FOC unless you can prove without a shadow of a doubt its there fault, even then proving it is likely to be costly
