Help/advice needed please ebay/paypal

Hi All,

Im a newbie....i need some advice from all you guys, apoligies if i have posted this in the wrong place...

Basically i bought and paid for an item from ebay-worth about £23 and the seller sent it by recorded mail but 5 weeks later i have not received anything at all..so in the 4th week i went ahead and claimed through paypal. I won the case, the item still hadn't turned up and again i logged in to look at paypal and the case opened again..it says the seller is appealing the decision, the seller is not very nice to deal with FYI.

As i'm out of pocket, and 5 weeks later no item still, can the seller really do this? it seems unfair, especially since i waited and waited for it to arrive. I hope paypal don't give my refund back to the seller, whats the point of item not arrived?! :(

    As long as the seller can't prove delivery (which he cant) he will lose the appeal. Has he entered a tracking number into the dispute? If so see what it says when you go onto RM.

    The only reasons that paypal would reopen for investigation is that the seller has provided some form of proof of delivery (not postage), or that you have made excessive not received claims in the past. Given that you say that you are new, I think the latter is not really an option though!

    What does the recorded Delivery number say when it is entered into the RM Track and Trace site? Has it been delivered to another address, and this is why the seller has appealed?

    The tracking id says something like still held at the handling depot-so it hasn't been delivered to a different address. I've not been making excessive claims, so maybe the seller has got more proof it was delivered... However the tracking does not say 'delivered' so surely paypal cannot give my refund back?
  • Missed your post ther cybob, thanks,...thats what i assumed as the seller sent by recorded post, the item still went missing, but they have appealed....yes the tracking no has been entered and says 'still held in the handling office, or something like that' it does not say 'delivered to....'

    I thought recorded was only held for 7 days or so, and with it being 5 weeks since purchase, then surely it would have been returned to the seller by now - unless they were very late in sending it out in the first place.

    Maybe an obvious question - but have you yourself contacted the depot that it is being held at to check for your own peace of mind?

    It's a curious one - I'll grant you that!

    Edit to add - it's not by any chance come from abroad has it, and there might a customs fee to pay that you have not been told about?

    You'd think it would be returned to the seller,..but it hasn't, the seller doesn't have it either. I have contacted my local depot but they don't seem to have iany parcels of mine...in any case its been 5 weeks since i paid for the item..i got my refund and now the seller has made an appeal. So i guess i got to hope paypal don't revert the decision, then i'll be 23 squid short :(
