Landlord Charges...fair?

    I dont think the LL stands a hope in hell of charging you, but did you inform the LL the rent was going in late???

    Is there nothing in your tenancy about what happens if your rent isn't paid on time.

    My previous tenancy included the following clauses:

    If you owe rent or any other money, you will have to pay interest on this amount from the date that it should have been paid. The interest rate is 4% above the rate used by The Royal Bank of Scotland.

    Pay £2 for the first rent reminder, £5 for the second and £10 for the final reminder.
    [FONT=Arial, sans-serif]Pay £20 for any cheque that does not clear.

    I'm sure my previous tenancies have had something similar- is this not the norm?

    I can't believe your Landlord does not have enough spare money to cover a months mortgage without getting charged. What happens if your boiler goes, or your house needs urgent repairs, will he be able to cover this? I would query this with him, and make your point that it worries you and will give serious thought to moving out, if he cannot guarantee there would be money for any repairs needed.

    People keep bleating on about the LL's rights, but tenants have rights too.

    Most reasonable landlords would be leniant if the rent was going to be late and they were informed in advance that was going to be late and given an estimated date.

    Unfortunately this Buy To Let boom we have had has lowered the standards of UK housing and living. The landlords who have bought the houses usually have no idea and do not have enough cash to maintain the house properly. Additionally, they ave pushed up house prices to stupid levels so a lot of people can't afford to buy a house and end up rentin of these cretins. For anyone that does buy a house they don't actually have a life as they have huge mortgage payments to make.

    Still at least everyone is 'rich' because their house is worth so much money (never mind the massive debts everyone has workedup).

    P.S. I agree that he can charge Interest, but £100 is too much. I personally wouldn't pay it, as I beleive it is unreasonable. I'd also hand in my notice and find a property with a better Landlord.

    Yes you are quite right, my tenant didn't pay his rent on time so I wasn't able to buy a euromillions ticket, my numbers came up and I lost out on £40,000,000. I am currently suing the tenant for this amount and I am certain to win.
  • Thanks for the opinions guys, to be honest we're probably just going to tell him to take it out of the deposit before we move out (after getting a copy of the statements of course :p). Not worth the hassle really. Thanks anyway!
  • Your late payment has no bearing on his commitments.....its his issue and should be a contingency. If my company pay me late it does not leave them liable to my commitments...although with both is an issue over breach of contract.....As said before you paid in not an unreasonable time but not ideal in their case but they are sailing to close to the wind if this has happened. I would move on and refuse to pay....as you also are haveing problems with maintainence. Find a good landlord ...but please pay on time as this will make the relationship so much easier......I pay mine 3 days ahead of the standing order to take into account of weekends and PH's...No hassle then comes my way and LL gets it early .
  • You cannot sue for consequential losses, which this is. Unless in the contract, you don't have to pay. End of story.

    I'd go after the LL to fulfil his responsibilities including the gas certificate and your deposit. If not lodged correctly, you can sue him for 3 x your deposit.
