Hotmail account hacked

Hi guys.
have a problem..
my fiance and i connected using his hotmail account and mine, which as you can imagine had 100's of personal mails back and forth, he from a different country etc etc.
long story short, he got seriously ill recently,and asked that if something happened to him i would log in there and change the password, delete the mails etc. in essence take over the account (he lives with relatives and uses a communal computer, was concerned personal info would get in the wrong hands...... very long story)
.. he died 2 weeks ago.
someone, a member of his ex's family, (i'm not on their christmas card list) seems to have gotten to the address before me and guessed the password and changed it. and is sending me the mails, a few a day, with horrible comments and stuff added in, from this email address.
so as you can imagine i'm in a dilemma. i'm ignoring the mails at present, but i'm upset enough about everything, without this. i want to log into this account and claim it back.
my question.. (i've tried everything to log in, and i dont know the answer to his secret question). his alternate email address may be another account that this person has hijacked, so i dont want to alert them to the fact that i'm trying to log in to it. i do have definite details to another hotmail account that i know they have not hacked. the alternate email would be one of these remaining 2 addresses and is also in his name.
can i change or check what the alternate email address is?/ i know the password etc for it, and it has not been changed.
i know it's a bit of a sensitive one and people might be nervous answering it, as it sounds dodgy, but i'm at my wits end.
