    If you were to hand your notice in based on your boss' antics, bullying, harassment etc then the Company would normally follow your resi letter up through their grievance policies and procedures (if it smells like a grievance then treat it like a grievance). I don't think you could proceed further with a constructive dismissal claim without exhausting the Company's procedures first. However, if you felt that things hadn't been resolved then you could proceed upon further legal advice - potentially could result in a compromise settlement. I'd always advise speaking to HR or another senior manager (if you could trust someone) about the situation too as the Company could argue that they were never made aware of any issues (if you took it further). They may advise you to raise a formal grievance before making any decisions. Keep your notes, records etc too.     Most definitely. It's been a very long time since I was a union rep and a lot has changed since then - but as danko says, you must exhaust the company's grievance procedure before going for constructive dismissal. It may still be that, after exhausting this procedure (in writing), you must also inform them that you intend to claim constructive dismissal at the time of giving your notice. It is also good to bear in mind that people who you currently work with will be unlikely to back you up - even if the current indications are that they will. The other thing is that employers are prone to lying at tribunals. Even if you feel that you may have the moral high ground, this is no help at a tribunal if an employer lies about you.
    Claims of being victimised due to recent motherhood and/or discrimination based on your gender usually make an employer sit up and take more notice as discrimination issues are usually the most expensive to settle.
    If you can't make it look like one of the above, settlements are linked to length of service and what a possible redundancy payout (plus some extra) may have realised.
    If you have worked there less than a year you almost certainly have no claim - unless a discrimination issue can be proven.
    If you have worked there more than a year but not very long, if no discrimination issue is proven then a payout may not be that great anyway and serves more to give satisfaction about being in the right. Many employers may consider this cost worthwhile to get rid of someone who they no longer want.
    Also, although it is illegal, it's likely that some unofficial blacklist exists and taking a previous employer to a tribunal would impact negatively on future employment prospects.
    Not trying to put you off doing the right thing but it's good to know the full facts before proceeding.
    If you are very unhappy there, maybe have a look around for something else and, after getting an offer in writing, just leave with due notice. This may not be realistic with current unemployment levels - depending where you live and what you can do.
    There can be great satisfaction in telling an employer to shove their job up their rear end (*yes I have actually done that whilst slamming the door loudly on the way out :D) but it's even more satisfying if you have something better to go to.

    Debt @ 31/12/23 £16k - no interest - will clear over 5 years hopefully.
    Emergency savings £4k - been ransacked over last year - needs attention :-(

    Did'n't get a chance to PAD yesterday, so double bubble today - £18 to the CC's.

    Rather annoyingly...a payment of £25 came out on my Abbey CC...so now i'm apparantly £29.02 in credit...and it'll take 7-10 working days to be credited back to my account! Why does it take so bloody long?! :rolleyes:
