Advice on rights needed pls -faulty purchase from Tesco Direct

Hi all
I bought a television from the Tesco Direct sale online, it arrived on Wednesday and all was well and working until yesterday, we came home and tried to switch it on...but there was nothing the television won't even switch on! I have just spent 40 mins on the phone to Tesco being passed from pillar to post eventually to be told that the tv is no longer available (after only 6 days!) so I will have to have a refund cos they can't exchange....Do I have the right to ask them for a replacement of my television with the closest one they do have in stock?

I dont really want a refund as the tv was a very good deal...or so it seemed...and I am very unlikely to get another one similar from anywhere else for the same price.

Thanks in advance

By law they have to repair, replace or refund. In this case they are within their rights to give you a full refund.

If you desperately want this TV, could you ask them to attempt a repair on it?

If not, have a look around, you may be able to find something similar for the same price. Which TV was it? and what price did you pay?

thanks...it was a Technika (their own brand I think) 32" lcd for £199....a very good price, the next one up they have is the same make and same size but has a different model number and is £319......I'm wondering if it is a better idea to phone the manufacturer and see what they say

Take the refund, save up a bit more and buy yourself a decent brand.

By law they have to repair, replace, refund at their discretion unless it fails within a reasonable time period(usally considered 28 days but time period unspecified) in which case you can demand an refund or replacement. They have choosen to refund you thus fulfilling there legal obligations.

You have no right to an alternative item at the same price.

If you really want that TV ring around some of the local stores and see if they've got any left. I suspect that with Technika that they never bother to repair they just refund and scrap.

Personally unless you desperately need a new TV I would save up and get a decent LCD.

Why would you want another tv, when the other one only lasted 3 days? I would be glad to get my money back.
