Advice sought on hi-sleeper bought from Argos?

Hi, I purchased a Hi sleeper bed from Argos and it was delivered the first week of Dec. It is the one with a desk and futon at the bottom. It took awhile to assemble but looked okay once finished and felt pretty sturdy.
The problem I have is that once my 8 year old daughter started using it, it would wobble. This has worsened and even though we have checked all the fittings I am worried it is not safe. The ladder swings out as she gets towards the top and anything placed on the desk shelf built into the bottom of the bed falls off.
I haven't contacted argos yet as I am not sure where I stand because obviously it was a self assembly item and I have had it possibly 28 days.
Any knowledge of my rights would be useful.

Just checked the website and it states 30 days for faulty items, doesn't state if this applies to large self assembly items though. My 30 days ended yesterday new years day will I get away with that it was a bank holiday.0

I have to say this sounds normal for these beds. I remember mine many years ago. A simple 1 up 1 down bunk (metal frame). I slept up top my brother underneath and one night without any particular stress applied the frame that supported me snapped crushing my brother. He was fine but there was a metal serrated edge 1cm away from his head (level with his eye) which made us think "what if". He could have easily died.
Anyways the point of that was that if you feel its unsafe, do not let your child use it. It may be fine though because as i have said, all beds i have seen are like that and are perfectly safe apart from my old one:rotfl:
Your rights are under the Sale Of Goods Act 1979. I would say that given the circumstances, you could "reject" (make sure to mention this in reference to the act) the bed as you have found it to be of "unsatisfactory quality" in a "reasonable" time (seeing as its worked loose over time and given the nature of product i would call this reasonable). This allows you to a FULL refund.

Ignore this, they can only enforce this on unwanted items. When goods are faulty stick to SOGA.Back by no demand whatsoever.0 -
Thank you, will follow up my email tomorrow with a phonecall and see what they say.
And thanks for the collapsing bed story, it puts my mind at ease lol. She will be on the futon until the bed is collected or thrown out - cant use it either way.0 -

As for phone calls, dont lol. Keep all communication email or RECORDED delivery. Its worth just phoning the store first as they may refund without quibble but after this, keep it to email and letters so you can prove what was said and when.Back by no demand whatsoever.0 -

I din't buy it from a store I ordered it on the telephone so that I could arrange a specific delivery date.
Also to return it, it will be in pieces (apart from mattress) and I didn't keep original packaging.0 -

Sorry, still have my sun glasses, night after the night before and all lol.
The packaging is irrelevant as if its faulty they cant re-sell it anyways.
As for returning it, you will have to find a suitable method to return it in its current condition with recorded delivery. It may be expensive but you can reclaim it from the retailer along with your refund provided you email a copy of the postage receipt.Back by no demand whatsoever.0 -
Is it a wooden one made by Thuka?
We've had a couple of these - a mid sleeper and a high sleeper. They were both really good quality and did not wobble excessively. There's obviously a bit of movement due to the high legs but when assembled correctly the ladder should not move at all never mind swing out.

Hi, no it is this one http://www.argos.co.uk/webapp/wcs/stores/servlet/Search?storeId=10001&catalogId=1500001801&langId=-1&searchTerms=6676043&Submit=GO+%3E it has been assembled according to the instructions and felt ok when first assembled, the ladder when first used was fixed and didn't move. Now even with hubby constantly checking and trying to tighten the the screws it wobbles terribly and the ladder won't stay fixed. There was only one way to assemble it and thats how we did it.
I was concerned over the wobble factor when she first slept in it but it has got much worse, she waited months for them to come into stock and is really disappointed but is also scared of the wobble so wants a 'normal' bed again.:o0 -
Update - phoned Argos this morning, absolutely noproblem with lovely girl on the phone they are collecting it on Saturday. Well done Argos.0
