Letter template

It's been 28 days now since our lease ended, we've heard nothing from our agents about deductions, so now we need to go about getting the full deposit back, stated in contract they had 28 days to discuss deductions etc and we've had nothing, so from what i understand we are now entitled to get everything back.... I mean 28 days is plenty of time for them to let us know.

Any ideas for letter templates?

is your deposit in a deposit protectoin scheme ?
when did you move in and when did you sign your last tenancy agreement ?

Yes it's protected by the scheme but held with the agents, moved in August 2008 and that was the only tenancy we signed, 6 months initially then rolling month to month from that.

in that case, just write a brief note, asking when you can expect the return of your deposit in full, as you have heard nothing from them about deductions in the time frame specified in their terms and conditions..

christmas does mean that many companies close down for pretty well 2 weeks tehse days....

i assume you have actually checked out with the deposit scheme that it IS registered ?

Yeah i've called them and they confirmed it was protected with them.

I work in an estate agents and we didn't close for two weeks! Plus as our tenancy ended on December 3rd if they really had any issues with giving the deposit back they'd have been in touch surely?

    How does this sound

    Dear xxxx

    RE: xxxx

Please can you advise as to the whereabouts of our deposit in regards to the above property, as it has now been over 28 days since our tenancy ended and we have not been informed of any deductions.

    Kind Regards

I think you should be firmer and less apologetic: this is YOUR money, you know it's whereabouts and you have the right to your money returning ASAP! What will you do if they say "Dear Bramble1, your money is in the TDS. Yours sincerely, Mr, letting agent"? There is no reason to mention any deductions, your standpoint is that there need be no deductions so why would you think to mention it? They have put nothing into writing, so don't give them a way in.

    "Dear Mr. letting agent

    RE: xxxx

As you are aware, one calendar month has elapsed since we vacated the above property. We are disappointed to note that our damage deposit of £xxx has not yet been returned, please rectify this omission as a matter of urgency.

    Your sincerely

    Bramble1"

Is that a bit too harsh though... i'm really nervous about sending it for some reason!

They won't be able to say the money is with the TDS as they themselves hold it, but the TDS protect it.
