CSA - Should I be on the old or new system?

I fathered a child 12 years ago following a one night stand. I do not see the child and have no contact with the mother. The mother tried to get maintenance payments from me back then in 1999, but I was at University and had no income, so was unable to pay. I did not hear anything from her until now. I have received letters from the CSA since May requesting my details, which I have supplied, as I am willing to pay. These have gone back and forth until now (delay in responding on their part!) Now (Christmas Eve!) I have received a letter to inform me that they will be taking £820 a month (for 10 months to include back pay to May) £460 thereafter, directly from my wages as I have not been complying!! I am going to loose my house over these payments, but the CSA don’t care.

It seems I am paying so much as I have been put on the 'Old System' rather than the new. When I have questioned this with the CSA they say it must be that the case was already open. Is this true? Can it be open for 11 years? Can I appeal this? Can anyone advise?

I am not objecting to pay for the child I fathered after a one night stand, but I do object to paying such a large percentage of my wages for the next 10 months. I will be financially crippled, loose my house and end up in debt.

The CSA have treated me like a criminal, they are a law unto themselves, no, they are above the law it seems. They are unable to explain the calculations to me using the old system, so how do they know if its correct? I have no faith in the 'muppets' at the end of the phone line. They speak to me like I am wasting their time!

Can anyone please help me!?:mad:

    I think you will be on the old system, have you asked them for a breakdown of what you are paying for?

    Can I get a more deatailed break down?
    They sent me a break down that was imposible to make sense of, and they included my partners income. I tried to go through this on the phone with the CSA, but they just kept insisting it is correct.

    I think it goes on household income rather than the names on the mortgage

  • Not if it is me that actually does pay all the mortgage anyway! Most of my partners income goes to a family member, who leant us money to buy our house. The CSA do not account for this, just her wages as part of the household income. I will not go to the lengths of fraud, but I dont want to lose my house, so Im looking at all options:(

    Doesnt matter who pays the mortgage, you are a couple who live together and CSA take into account the household income minus any debts!

    Think you must be on the reciving end of their magical abacus .Doesn't make sense that they are taking £820 amount for 10 months then going for £460 after that .
    Not being cheeky what is your salary as they are not allowed to take more than 40% if they have a deductions of earnings order (as i have) also arrears can be negotiated but they like them paid back within 2 years although mines will be 21 months .

    Ask them for an account breakdown also .

    Write to the data protection unit (Address on the NACSA website ) to see what has been bubbling away in the backround over the last 12 years .

    Ask NACSA for help also (£50 subscription) well worth

    No it wouldn't count as fraud .

    I am a non resident parent(NRP) and my partner hasn't supplied her details as she is not legaly obliged to do so .The CSA know everything about my partner as her name is on our mortgage papers but dont use her details that is why i am on a cat b interim maintenance assesment .I was told by the CSA there would be no benefit to me to supply her details .

    SO THERE WOULD BE NO FRAUD COMMITED

    can i just say onlyhope my hubby and i are in the excact same situation i thought it was just us at how unfairly the csa were treating us, they are happy to see us homeless and jobless which would result in them not getting csa but thats how far they will push it,
    hang in there and keep asking for full breakdowns you will finally get them hubby is on the new csa which i beleve is slightly different but not sure

    also just reading back on a few posts im sure csa take 60% of hubbys wages is this not right then??
