Hi all!!
After some advice from you guys!... am currently working as a joiner (20 years manufacturing)… in feb I go to hospital to assess whether I need an operation on a injury caused by my work!, if I do then I will need to claim as I don’t get sick pay! And will need to cover my living costs ( 2 kids 1 wife ).... but it is looking quite likely that the firm will going into administration before then!... yep 2010 is looking like a good year lol!!!... my mortgage and loans are covered (only for 12months though)… but what I need to know is can I still claim against a company that doesn’t exist as I wont be able to work for at least 6 months after op? Which will take me into a period where my mortgage insurance stops paying????

ps. have only worked for this company for 4 years... not 20 so not expecting a good redundancy pay out ....0

What do you want to claim?I am an employment solicitor. However, my views should not be taken to be legal advice. It's difficult to give correct opinion based on the information given by posters.0

Yes you would still be able to claim even if your employer does go bankrupt. That is because the claim would be paid by the employer's liability insurer, rather than the employer itself. Of course, you would have to be able to prove that the injury was caused by your work.0
